Hello, I need to do a PFD for a CBUSA charge-off from a year ago. DOFD was 2 years ago. After I went through and (thought) I paid all of my credit cards off completely, they stopped sending me statements. I never got a call, a card, a statement. Nothing. I noticed recently that they are reporting a charge-off of $613 on my credit and thought it was a mistake. I disputed through the CRA's but they verified and even put it on a TU that it wasn't on before. After many phone calls trying to track down a number for them (seems that noone at Citi/Hurley State Bank/Gateway Computers seemed willing to aknowledge that I ever had an account there. Finally got a gal who was very rude. Refused to PFD and claimed I owed them the money and better pay. Well, this is a charge off. They have not been calling me and from what I could tell the last 2 years have never been interested in collecting a dime from me at all. I CALLED THEM OFFERING TO GIVE THEM MONEY. Yet, they seemed uninterested in working anything out at all in return for deleting the TL. I was not trying to settle. I'm perfectly happy to pay them in full. Does anyone have the contact of a higher-up at CBUSA/CitiCards that I can contact either for a GW letter along with offer of PFD? Also, if I pay this charge-off, will it then stay on my credit longer than if I just let it fall off in 5 years? The rude gal from Citi said that it was 10 years either way! Thanks

At most 7.5 years from first delinquency, whether you pay or not. See FDCPA. Maybe you could contact this gentleman, and explain that you are trying to pay off a debt that you thought had already been paid off, but can't find anyone who will take your money, and their employees are giving you erroneous FCRA information. That's what I was hoping to do, however I did look at the CitiGroup website and found the VP in charge of CitiCards as well as several other executives that seemed as though they'd be in a position to help, however I have no contact information for any of them. Any idea HOW to get a hold of this gentleman or anyone else high up at Citi? Thank you very much.

Why wouldn't it be from the date of first default? Why is a charge off reported for 7 years from the date of charge-off?

The 7-year period referred to in paragraphs (4) and (6) 3 of subsection (a) shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action."
Thanks. Anyway, the gal told me that it was 10 years that it would stay on not 7 or 7 1/2. Is that a violation at all? I'm just looking to get leverage. I don't want any money from them, but I want any tool I can get to get this deleted. Thanks again.
