Anyone ever sue 4 consumer products

    This is OT, but there are so many legal experts here, I thought I'd ask.

    My husband and I bought a box of cereal yesterday. We opened it this morning and poured some for each of us and our toddler. Started to eat and then realized that it was full of moths, cobwebs and other nasty things. The expiration date isn't til this summer. This REALLY grossed us out, we don't know what else we may have ingested. So far none of us has had any adverse affects but we're really really disgusted. We've been talking about sending the company a CRRR letter with photos of the box and the cobwebs in it and more moths, a sandwich baggie with samples, a copy of our receipt and a demand for payment of some amount for each of us ($2500?), with the statement that if they do not respond within 10 days we will file suit. The limit for small claims court is $3000, so we would file 3 separate suits.

    Anyone have any experience with this?

    Umm...

    bugs etc are not harmful as gross as they may be. In fact the federal govt allows certain "unpleasentries" in consumables :)

    YES I AM TALKING ABOUT RAT POOP! LOL

    The company will prolly bend over backwards to satisfy a customer, you may be eating that cereal for a lifetime free :)

    NEGLIGENCE is the key word here. Was it the manufactorer or the shipper or the retailer or the consumer who cause this ?:)

    Too many factors involved.

    I remember reading a story about the levels of rat poop in peanut butter - ick!!! in this case, it is an INFESTATION - those bugs are EVERYWHERE!!! That's why I want to get the letter in the mail tomorrow - we have the receipt to show we just bought the box yesterday - not enough time to develop a full blown infestation in our house. I agree - they should be concerned enough to respond - that's why we don't want to be outrageous in our demands - only what we could pursue in small claims. Noone died, no matter how disgusting the situation.

    Hey Poochie, are you doing OK these days? You just brought back a memory of my Mom drinking a coke (8 oz glass bottles) ack, showing may age, anyway, and finding some black gunk in the bottom. She called Coca Cola immediately. They were out there personally within hours, with a couple of cases of of cola for her.

    I bet you can find an 800 number for the manufacturer pretty easily on the internet...might be some nice entertainment for you guys.

    Bugs are full of protein and have a crunchy texture. Yumm...

    Perhaps it's a test batch of Fear Factor Cereal?

    I'd think the first path to take is to simply call the 800 number on their box. They *should* be very interested in whatever information is stamped on the box so they can figure out how bad the problem is. I'm sure they've got forms and procedures on how to submit your claim.

    I remember when I was a kid, a girl in my 4th grade class wrote a note to the Nestles company about how she got the word "quick" incorrect on her spelling test because Nestles had a product spelled Quik. She got a box full of Nestles products.

    Now that's just cool. I love chocolate. I can't wait til my 4th grader gets home.

    LOL!! That's great about the Nestle chocolate!

    Out of concern for slander (not that Big Brother is watching or anything!!) I don't want to name names but I will say it is a flake cereal with dried strawberries and almonds. And if the problem is with the whole production run you'd see it right away. YUCK! I had to scoop out a sample to send to the company and those bugs were EVERYWHERE!!

    Thanks for asking Jlynn - I'm still hangin in there. I signed my papers for Chapter 7 today, which will get rid of the deficiency once and for all. I hated to do it because I always had great credit. But I realize that it's the best choice for my circumstances. Everyone I've talked to who has gone down this path tells me that once the discharge is finalized I'll feel like a new person. Maybe that new person will have perfect vision and size 8 hips too!!!
