Anyone ever sued Providian and won?

    I sued Providian in Beverly Hills Superior Court and boy have they put up a terrific fight. I sued them for violating FDCPA/FCRA/FTCA trying to collect a debt they sent to three different CA's, (they sent it to one CA twice). They even countersued me!

    Today was court... didn't go great, didn't go bad either. Curious as to anybody else's experiences...

    Why did they countersue you? What was their claim?

    They countersued me to intimidate me, I would imagine. Why else would they all of the sudden decide to file after a year? The countersuit is to try to recover the balance of the credit card, which I had repeatedly disputed.

    Do you have a lawyer or are you doing this by yourself?

    I'm doing this by myself. In California small claims, you are not allowed to be represented by an attorney.

    You said that you are in "superior court" is that small claims in Cali?

    Sorry for the confusion. "Superior Court" encompasses all level of civil and criminal court in California, including small claims.
