Anyone get paid $1K for unauth hard

    Hello! Bank of the West pulled my credit report on Feb 20th without my authorization. I called the on 2/25 and they said it was wrong and did not have my signature authorizing to do so. Well they said three seperate times now that it will be deleted from my file and a letter will be sent. Well, guess what? no letter so far and it's been over a month now. So, I sent them a revised letter that Butch had posted (Thank you Butch!) demanding deletion of the inquiry and a check for $1,000.

    My question is...has anyone ever gotten a check or do they just delete and figure that you will settle for that?

    I have heard of people getting paid the $1000. They owe you that money, don't settle for just deletion.

    Liss check bayhouse .com read in forum are from christene I think has the acctual letters responses and check sent to her.

    I Have sued on two ocaasions and won both. Two issues that are compelling... Credit lowering (hards) and invasion of privacy (hard or soft).

    do you have a link for the letter you sent BOW?

    I have a similar experience with Target (RNB). I specifically told them not to pull another hard inquiry when considering my applicating for a guest card and they went ahead and pulled both a hard eq inquiry and a soft ex inquiry!

    Thanks for the website, I will check it out. now here's another problem from Bank of the West. They now ut me on my husbands car loan, and it'snow reporting to my eq and I am not even on the car loan! What letter should I sent them?


    Here's the letter that I revised from Butch...my only problem, is that I wasn't thinking straght and I gave them too much time to react. Oh well...


    To whom it may concern:

    Upon reviewing my Experian credit report, I noticed that Bank of the West obtained my credit report on February 20, 2003. I did not authorize this inquiry.

    § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n] (a)(1)(B) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;

    When I originally called Bank of the West to discuss the inquiry on February 25, 2003, I was told that my credit information is on file and missing my authorization signature.

    I have contacted your branch three times now, to no avail, the inquiry remains on my Experian credit file and I have not received a letter, as promised, stating that the inquiry will be removed.

    Please explain your permissible purpose for obtaining my credit report.

    Please IMMEDIATELY DELETE the inappropriate hard inquiry from my Experian credit report. An inquiry without a corresponding account is VERY detrimental to ones credit score. Please arrange for payment of $1,000 by 5/20/03. Unless both of these remedies are supplied by 5/20/03, I will be forced to file suit against you for numerous willful and negligent violations of federal law, state law and my rights as a consumer.

    In your written reply please provide the name, address and phone number of your "registered agent". Your reply can be faxed to: (xxx) xxxxxxx.

    HOW CAN YOU TELL A SOFT FROM A HARD INQ.? I just rec'd husbands experian report via mail, and they don't differentiate, except to say ar or whatever. there is an inq. on there from some alarm system that i know we didn't apply for.

    Experian breaks it out into 2 sections, one for hard and one for soft

    Along the same lines...

    I just had a TL re-inserted without any notice from the CRA. I happen to have a letter from CA stating it would be deleted, so i know it didn't come back because it was verified as complete and accurate.

    That's 2 violations according to FCRA...would you all just worry about accuracy or go for the $??

    I bought a modem from Cox. They pulled an inquiry and never told me they would. They never even asked for my social. I had them about 5 yrs ago, and I guess they still had the info. Anybody ever had Cox check their report? I am not even renting the modem. I bought it. All they said was they were sorry.

    They need to say they are sorry with 1000 $1 bills!
    ITS and then sue the Bxxxxxds! There is NO excuse for pulling CR for buying a modem.

    That's what I thought, thanks. Excuse me for being a newbie, with a newbie question, but what is "ITS" Is there a form letter for this? Do I send them one first? Thanks again!

    I had NCO pull 2 hards on my report this week. Problem is, first CA didn't validate, and now they or the OC has sent this to NCO. Does this count as non pp?

    Hi Liss,

    Sure, I've been paid too. When we examine the law we see that they have no choice. Unless some rediculous judge can't read, which is entirely possible.

    LOL

    I like your letter tho. :)


    Nothing seems to happen with these people until you begin a formal paper trail. Now that you've started same, you should get some quick response.

    Be ready to settle for half if they will make it easy.

    Deletion plus $500.

    Keep me informed as to what happens from here on out.

    I have collected from Sherman Acquisitions and am suing Sears this weekend for pulling an unauthorized hard.

    Next week I sue Sheman again. They just never learn.

    Do they usually settle with a letter? Has anyone ever filed? I am afraid to threaten Cox, if I am using their services, anyone have any input on this? Thanks!

    Lynette,
    Cox can't retaliate against you by interupting your service or pulling any underhanded shenanigans. They broke the law and have to pay the price--end of story. Don't be sheepish--the law says you are entitled to $1000 minimum.

    and you know the bad thing about buying that $60 modem? you could have went to best buy and bought it for under $25, then turned in a rebate and got it for free. cox *isses me off, but they are the only high speed internet connection company available in my area.
