Thanks you guys. I think I will do that. As far as the modem, I paid 89 for it. I didn't know I could get one for 25! They (Cox) told me I could get one at B.Buy for about 69, but it wouldn't come with 10 yr warranty, yada yada yada. Well, I guess I fell for it. They are the only service in my area, as well. I think I'll go to Planet Feedback and get started with a letter, thanks!
I going through this (unauthorized inquiry) with Retailers National Bank right now. I sent them a letter at them end of March demanding proof of a permissable purpose, and that if they could not provide this, I would settle for $1000.00 and deletion of the inquiry, and I would not pursue legal action. I have not received a response yet. I will give them until the end of this month to respond, and then it is off to small claims court.
Cmon now Lynette, No PP cases are pretty much a dead lock. If they have no permission they are liable, hard OR soft. However, this is too important for you to turn to Planet Feedback to deliver your demand. Use paper via CRRR. Be sure to put the actual Cert. Mail # inside the letter right under the address of the recipient. ALL you guys seem to have good no pp cases. Look under my name and you'll find some examples of letters I've used to get paid. ummmm...I actually got paid $1500.00 for one unauthorized hard from one creditor...an OC...and $700.00 from a CA...I can't mention which ones...but if you read my old posts...you can put 2 and 2 together....I small claims'd them and got what I wanted......sorry no more info...confidentiality agreement...

(3) In the case of liability of a natural person for obtaining a consumer credit report under false pretenses or knowingly without a permissible purpose, an award of actual damages pursuant to paragraph (1) or subparagraph (A) of paragraph (2) shall be in an amount of not less than two thousand five hundred dollars ($2,500).

Only bad thing is that I already sent out a letter asking for $1,000 per non-pp. Would sending a revised letter invalidate my case? How did you word your letter? In california law what does it mean by "natural person"? Does that mean there is a problem with zombies pulling credit or does it just exclude anyone who works for a corporation?

I faxed the revised to them and CRRR. And this time, I gave them less time. It can't hurt, I guess. Good luck!

In fact, according to USPS on-line tracking of the certified mail receipt number, they have yet to even sign for it! This got me angry. So, today, I looked up TGT fax numbers on BBB and I faxed copies of the letter to each fax number. http://www.mnd.bbb.org/commonreport.html?compid=342 I will also mail the letter again by CRRR but this time, addressed to the CEO, and will continue to fax every day until I receive a reply. It was signed for on March 24, by L. Cotter. If I don't have a check or response by April 24, it's off to small claims court. Did you get any response from your fax?

A few days ago, I sent another CRRR letter to the CEO of Target Corp at P.O. Box 1392. You can find many mailing addresses and fax numbers at the Better Business Bureau On-Line at http://www.mnd.bbb.org I have also been sending faxes of my letters and then printing a daily log sheet including time and date that faxes were sent. Here's the dilleo...I sent my ltr and I just received a letter back from the "Vice President" of Bank of the West. What happend was, is my husband was applying to buy a car and I was not there...I repeat not there with him. But he put down my info since for income purposes. But the finance person said he would not pull any info on me since 1)I was not there and my signature is not on the app & 2) Only if he needed my to qualify. On the application the car loan guy even wrote over my info "WIFE TO SHOW INCOME ONLY". This was on February 12th. So they did not need me to sign for him to qualify and he got the car that same night on feb. 12. Well now on February 20th, Bank of the West pulls my credit report! I am not even on the freakin loan either, no sig from me and the application says for income only! In addition, I am not even on the car loan papers and they are reporting that too, on my cr. I called them 3x and they said they were wrong and they would remove the inquiry. That didn't happen, so I wrote them a letter and this is their response...."Section B. Information regarding spouse, or Co-Applicant" portion of your application was completed, which authorizes the bank to inquire on both applicants.... Do I still have a case to go after them? I think I do...or anyone could say they are your spouse and uput you down as a co-applicant. My husband feels terrible, but it's not his fault. Please help!
