Hello, Has anyone had any luck disputing the "unknown lates" on EQ reports. I've sent them the "I was nver late on the unknow dates" comment and they verified. Has anyone quoted FCRA in an attempt to dispute this? Please share your feedback or sucess stories. Thanks!
HOW CAN THEY VERIFY IT WAS LATE ON AN "UNKNOWN" DATE??? Send another letter asking which "UNKNOWN DATE" are they talking about???
You think you were not yet out of JR HIGH SCHOOL on that "UNKNOWN DATE"...(so it would have to be WRONG)!!!
They are a bunch of idiots. I even contacted the OC and they were unable to provide the dates because they do not keep information that old (from 5 or 6 years ago). I did ask them to provide the dates that I was late on and of course, they do not read the letters or choose to ignore us and send the standard "this item was verified/remains" answer. This really ticks me off. I was wondering if anyone had any sucess with any other way of dealing with this. Thanks!
Read the FCRA section 623. Use that and threaten to report them to your state AG and the FTC. Might not do any good, but wouldn't hurt to try. Gib
I had luck with sears and target. They had reported me late 90 days 3 times 60 days 3 times and thirty days 3 times. I truely did not remember being that late.So I disputed it. I called and asked them to pleas give me the dates for all of theses reported alte payments. They said that thier system did not go baclk 3 years so they did not show those late payments os I said well will oyu delelte them from my credit file. Target said we can not delelt what we can not access to. Well after three months target said they would delelt "all" references tolate payments. Becaue thier system was not showing the late ( mainly becaue thier customer service system does not go back that far). So I got all old late payment entries deleted my score went up 50 points. I was persisitent. With sears soem how I asked for one curtesy deletion and they delelted all late payment entries go figure. this help my score jump another 20 points. It nice when they do not delete exactly when they say. They feel so bad they will delelte all notations of late payments. This has been my exp. I almost have perfect credit ( one last charge off to take care of )
Looks rather clear cut to me. Tell me where I'm wrong. If they can varify an alleged late pay on a certain date, that's understandable. Obviously they cannot varify that you were delinquent on a date that they don't know. Therefor they DID not varify. I've suspected this with EQ. If they DID varify that means they were given the date in question. If that's the case then they have failed to accurately report their findings, another (albeit different) violation. You have them between a rock and a hard place because either they are in violation of the FCRA OR they are in violation of the FCRA. It's clear on it's face and you have the documents to prove it. I would sue on this one for sure. Be sure to include a motion to clear your file.
