Anyone Know The Outcome?

    I don't know but, I hope the Plaintiff won. That is a lot of work to absord without any recovery.

    I have been researching anything and everything to help me in the NAF award to JDB.
    I am not going down without a fight.
    This is my last problem and one I have lost so far as NAF as I have written in the past in a jabberwocky place. At least I will have a say in real court one way or another.
    If anyone can give me any info that may help me stop them in their effort to affirm award please do as this will help many people after me.

    Try to find Strunk v MBNA and see if that helps.

    I found the Michigan Court's site at: http://courtofappeals.mijud.net/resources/public.htm

    According to the docket on file at: http://courtofappeals.mijud.net/res...540&inqtype=public&yr=0&yr=0&SubmitBtn=Search it was dismissed Sept 13, 2006. The order of dismissal can be read here: http://courtofappeals.mijud.net/documents/coa/public/orders/2006/270540(30)_order.pdf

    My guess (from the cheap seats) that if they lost on appeal they'd be in deep water should any future debtors put up a fight over their arbitration.

    Ironically, I received a letter from BofA saying they were amending my cardholder's agreement to include arbitration. I sent them a letter saying that I do not accept this change and opted out. They up'd my credit line.

    Go figure.

    So then STRUNK got stuck with the award being affirmed? UGH..

    They came to an agreement, the two parties, which stipulated to dismissal. If that is somewhere in the record (or available somehow), it would be interesting reading. Did Strunk pay some? Did the other side get so scared of leaving case law that it just folded?

    I would really like to find what the record read. To me it means that Strunk was the winner,as why else would this be dismissed? Obviously if it came about that the award/judgement was going to be dismissed then this would be bad for NAF.

    Well I really need to find any info I can on cases like this, as like I have mentioned an award has been issued and soon they will try to affirm.
    I have been working on this for a long time so at least I will not go lighty..

    Certainly there is more to the record than is available to us online at the site we saw the docket and could get the orders. Perhaps you should call the court and ask for a copy of the stipulation, something seems to be in the record. Whatever they charge, it will be a better answer than you've got now.
