apology

    i want to apologize to any member or quest here that may have been confused due to my postings and discussion with hiding90 in relation to validation vs disputes etc.

    I wanted to clarify that I was sharing my experiences in the methods I have used and have achieved great success in.

    I expressed my opinion and choose to not post and more answers due to the disagreement and confussion it has caused.

    I am upset that one would agrue their intrepretation of law to be fact when some of the information is in fact inaccurate.

    NO need for an apology, disagreement can lead to education.

    It is far better to research FACT then to argue opinion:)

    I would encourage you to keep posting, it spawns learning and eductation for all.

    However, I would caution against poster what had worked for you as being "legal".

    The means DOES NOT JUSTIFY THE WAY in many cases.

    In this case, a dispute sent to a furnisher may actually cause the furnisher to delete the entry. BUT, IT IS NOT BECAUSE THE LAW REQUIRES IT.

    If you are "called" on the law, and you are WRONG, YOU CAN BE LIABLE UNDER THE SAME LAWS THAT PROTECT YOU!

    Disagreement is the Reason for these boards. well, one of the reasons....

    I believe hiding90 has went to work for a CA during his absence and now that he has been schooled by his supervisors, he is trying to spread the mis guidance. Jimmy Jones tried that once and see where it got him....

    -Id love to be able to post positive info and tell everyone what they are doing on here is the right thing to do becuase "it sounds logical enough", but wouldnt the truth be much better in the long run?

    -I have played out scenerios in my head about what would happen if a consumer took the advice of some of the "nice" posters on here and the matter wound up in court.

    -If the consumer thinks their credit is poor before, hows about a federal judgment against them for bringing a bad suit etc sound??

    I would also venture to guess that FUN4U2 actually talked to his attorney and was "set straight" about the matter we were discussing, and that why he/she is not posting anymore.

    Sometimes the truth hurts.

    I am curious why a higher standard applies to me when I post than anyone else. When I post, I have to "prove" everything I say, but when I challenge someone, like FUN in this case, for "proof", they are not required to back up what they say?

    The laws are to protect the "least sophisticated" consumer. Unfortunately, "least sophisticated" includes those who refuse to accept differences in what they had previously read or thought they knew about the very law designed to protect them.

    I posted before about showing me at least one post where I posted erroneous info, and why it is erroneous, Ill make that an open challange to everyone!

    I have no problem admitting when I am wrong, and do not expect praise when I am right. I do however deserve RESPECT :)

    FDCPA 813?

    In case you havent, Ill quote the section for you:

    "(3) in the case of any successful action to enforce the foregoing liability, the costs of the action, together with a reasonable attorney's fee as determined by the court. On a finding by the court that an action under this section was brought in bad faith and for the purpose of harassment, the court may award to the defendant attorney's fees reasonable in relation to the work expended and costs."

    Then there is FCRA 616 and 617:

    616-"(c) Attorney's fees. Upon a finding by the court that an unsuccessful pleading, motion, or other paper filed in connection with an action under this section was filed in bad faith or for purposes of harassment, the court shall award to the prevailing party attorney's fees reasonable in relation to the work expended in responding to the pleading, motion, or other paper."

    617-"(b) Attorney's fees. On a finding by the court that an unsuccessful pleading, motion, or other paper filed in connection with an action under this section was filed in bad faith or for purposes of harassment, the court shall award to the prevailing party attorney's fees reasonable in relation to the work expended in responding to the pleading, motion, or other paper."

    -So once you stop laughing, think about it again :)

    Not a suprise you didnt address the post.

    Just out of curiousity, if I am so inaccurate, and work for a collection agency, how is it that I am about 15 for 15 in small claims court AGAINST COLLECTION AGENCIES AND CREDITORS AND REPORTING AGENCIES, and 5 for 5 in federal court, and have several more pending?

    Maybe, just maybe, I actually know what I am talking about, or maybe I picked up a thing or 2 along the way?? Maybe?

    That's always a possibility, and I'm sure it's a possibility everyone is aware of. But somethings are worth the risk. And if I know without a doubt that there is an inaccuracy, you better believe your arse that I am going to march into any court room and defend myself. I will not take this crap lying down. Once you give in, it's all over!

    Well there's an inaccuracy there. You are making an assumption based on your own personal opinion. In fact, Fun4U2 is still around, sharing her experiences and her "recommendations" (pleae note they are personal reccomendations). If her reccomendations are not successful for me, I will go another route. You can drive across the country using more than one path, some prefer to drive the standard, I prefer to try new things.

    Once again, another personal opinon. The laws are to protect EVERYONE. Not the "least sophisticated" not the "most sophisticated", EVERYONE! Furthermore for you to make an assumption as to one's level of education, or class (or sophistication--as you ever so PC put it) is a direct attack at everyone here. How dare you! You know nothing about anyone here, other than their "names" and a brief snapshot of their minor life problems. I could be typing to you on an original 1970 mac from a barn while washing my cow, I could however be typing to you from a Penthouse Condo in West Palm Beach. Never imply that someone is anything of a lower civilization than you for you do not know where they come from.

    In your case, I think you need to EARN RESPECT before it is owed to you by any human being as you are the last to give it, and the first to make a poor attempt at gaining it.

    -NO, NOT my opinion. THIS IS THE STANDARD BY WHICH THE LAWS ARE JUDGED, FROM THE VIEWPOINT OF THE LEAST SOPHISTICATED CONSUMER. THIS IS THE COURT SAYING THIS, NOT ME!

    -And if you are in contact with lovely FUN, then ask her what her attorney has told her about FCRA 623.

    -IF SHE can claim her comment are FROM HER ATTORNEY, then I can comment ABOUT her attorney's comments.

    You can voice your opinion all you want, but it does not give you the right to MATTER of FACTLY call her attorney incompetent. Especially not when he does not have the right to defend his thinking.
