Are we doing CRA's a favor here?

    If I successfully dispute a negative item on my credit report, only to have it reappear again a month or two later...and, if I subscribe to Creditwatch and CreditExpert, when they notify me via e-mail that there's been a change in my file, and I login and check my new report, and there is the reinserted item -- (Whew!)
    Does their notification of the "change in my credit file" fulfill their obligation to notify me within five days of the reinsertion?

    I would interpret this (from FCRA) to mean "no it does not fulfill their obligation":

    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (5) (B) Requirements relating to reinsertion of previously deleted material:

    (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion

    (I) a statement that the disputed information has been reinserted;

    (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and

    (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information.

    TO MY UNDERSTANDING, CE & CW ARE FULLFILLING "THEIR" OBLIGATION TO NOTIFY YOU OF A "CHANGE". THEY ARE ONLY A "SERVICE" THAT PROVIDES YOU "ACCESS" TO YOUR FILE. IT IS STILL UP "EXP & EQU" (CRA's) TO "PROPERLY" NOTIFY YOU THAT "THEY" HAVE REINSERTED AN ITEM WITHIN 5 DAYS OF DOING SO. THE MONITERING SERVICES ARE NOT CONSIDERED CRA's. THEY ARE SIMPLY PROVIDING ACCESS TO WHAT THE CRA's ARE DOING TO YOUR FILE.---MY OPINION---
