I have contacted 3 lawyers from Arizona. One tells me they can't touch me, one says "i don't know", one says "declare BK". 9 years ago I had a judgement entered against me. Previous to my marriage ( my wife was 16 at the time of my judgement)I had paid off 49% of the principal. One month before my marriage, I offered to settle for the other 51%, lump sum. The creditor declined. I consulted a lawyer, who informed me that they could not attach any community property that I did not bring into the marriage, unless acquired by gift or inheritance. I had nothing, (my wife is better at finances than I am) so, I said bye-bye.(NOTE: the original collections atty. dropped me completely after she informed me that the debtor refused to accept my offer...no calls, no garnishments..they knew where I lived, they knew that I had gotten married, they subbrogated the loan on my house, they knew where I worked, etc...) Since then I have bought said house, my credit is in the 700's and things are going fine. Enter new attny. He is trying to attach everything that he can get his hands on. And being the good little researcher that I am, I have found 4 seperate incidents of case law (2 from AZ and 2 from other states that reaffirm AZ law in reference to foreign judgements) that reaffirm my original lawyers advice. Problem, I can't get in to see this guy for 2 weeks and I get paid on Friday. Also, they have NOT served me with ANY paperwork in reference to their writs, and have not provided my with an opportunity to respond (letters, certified mail, service). Now, I would still like to settle for 100% of the principle, but am unable to do so for 180-240 days. Right now, I just need a lawyer who has dealt with this previously, or is at least willing to LISTEN to me without treating me like an idiot. I have contacted two attny's in the past two days and one will not even accept faxes of my research, and I have offered to pay in cash, check or credit card their normal hourly fee. This is freaking unbelievable. The other guy said that I was on the hook, and when I persuaded him to listen to me, he finally admitted that he did not know. What the hell is that. I am considered a proffesional in my field, and at least I don't guess, if I don't know I refer someone who does. Sorry for the rant. Ideas?
have you thought of checking with the Arizona state bar association ? another suggestion go to a website called lawguru.com and type in your state this will search for attorneys in your state and give you there area of practice. this site also allows consumers to ask a real attorney a questions on various laws for each state. Findlaw.com may also be of some use to you
Seems to be something in the Arizona water. LOL Can you/do you have proof he's overstepped his bounds? You'll probably need to handle this yourself. How much? ??? .
An Arizona Judgment is good for 5 years,it is apparently renewable for additional 5 year periods indefinitely. Have you checked with the Az Court to see if it WAS renewed? Is the CA who has contacted you given you any proof of he judgment having been assigned to them LEGALLY, (recorded assignment at the Court)? It is POSSIBLE that you have been contacted by a "garbage" CA, who has only the old data of your old judgment and has NO legal right to collect on the account at all.
