I finally pulled my credit reports after Arrow Financial started contacting me about a supposed debt I had from GECC/Wiz from back in 1998. I asked them to validate twice, and after the second request they sent me a letter saying that I was past due on $0.00 and that I needed to send them $0.00 immediately. I interpreted this to mean that they were flushing the account out of their system. WRONG! After sending me a $0.00 letter, Arrow then sent a letter (about a week later) to an address I no longer live at demanding that I pay the entire thing. They then followed up from a letter from a local attorney demanding payment or they were going to sue. Since Arrow clearly had my correct address, I can only imagine that their intent was to get a default judgment by serving me at an old address. This address pre-dates the end of my use of the card back in 1998 - I changed the address with the OC back in 1997. As you can imagine, I have just finished my letter to Arrow, the Attorney, and the NYC Department of Consumer Affairs (they license Arrow in NYC) detailing their fraud and demanding validation now or I am going to sue. Can anyone think of anything else I could or should be doing? Thanks, Nester

Well, this morning I sent letters to the NYC Dept. of Consumer Affairs, the collection attorney, the Illinois Dept. of Professional Regulation, and of course, Arrow Financial. We'll see what happens... Nester
Hey, it looks like Arrow is back to their old tricks again. Watch these clowns carefully, I have got into the pissing contest with them and needless to say I won! They never validate, I sent my validation request as an email and also CMRRR, Got return receipts off the email, 2 of them, and also the green cards, when confronted with the evidence they sent the account back to the OC. I just got hit with an invalid collection from these @!?@!# on my CR's and it is the most blatent violation of the law I have ever witnessed! They sent a coll. ltr to me in 10/02 for a 00 account, which I requested validation immediatley. They NEVER responded. In the following month, they sent two more collection letters as if I never requested validation. I sent another stronger ltr that threatened to sue because they did not validate and they continued to try and collect on this invalid debt. I never heard from them again. They just reported this coll. to the CRA's in further violation of the FDCPA and now the FCRA. I will sue immediately, these people are criminials and they have to be stopped. BTW, the OC originally was incorrectly reporting this acct and after not being able to send any documentation and reporting incorrect data, they could not verify to my CRA dispute and it was removed in 4/03. I think they sold/assigned the account to Arrow in Jan or Feb. If there are others on this board that are dealing with them in this kind of way, I suggest we "coordinate" our complaints and launch suits. I also checked the BBB ratings and it is horrible. They have hundreds of open complaints! Will2win
What a beautiful place to insist, that under circumstances like these we should be billing our adversary. Most of you know I've spoken a lot about Prima Facie Evidence. Just as surely as a CA has a right to, after 30 days of no contact to the contrary, assume the debt to be valid, SO DO YOU!!! If you send them an invoice for $200.00 and 30 days goes by without notice of a dispute of YOUR bill, YOU may assume the debt to be valid, and proceed with collections. Start billing these idiots for your efforts to do THEIR jobs. Along with your initial attempt to repair the problem include your fee schedule and inform them additional work will be billed accordingly, "For Services Rendered", as follows: My Fee Schedule: $75.00 for each additional letter, PLUS the cost of CRRR. $135.00 per hr. on the phone, 1 hour minimum. $135.00 per hr. for legal research, case law, statute compilation. 1 hr. minimum. $1.00 per mile driven. $0.45 per page for photo copies. These are MY rates. BTW - For those who have MSWord you have several "invoice templates" in your template library. Do it. You'll be astoninished at how fast they jump. lol
Attorneys MAY NOT send letters out in their name unless they have an active, personal involvement in your specific case. If an atty. did look at your case wouldn't he have discovered the error? Answer: YES Therefore no involvement = violation. I'd prepare for a federal case Nester.
Oh I forgot to mention I've slightly adjusted my fee schedule. $1.00 per mile driven; $10.00 to start the car. Get it?
