I'm still waiting for validation from Arrow. Instead of validating they sold the debt to another ca. I asked them for validation and they couldn't. validation so quickly and so detailed? from Arrow and Asset? Bogus????

I agree re the accuracy/turnaround of the CA validations, but I still stand by my statement that Citi could easliy provide all that to them if asked. It was the reference to Citi that made this initially believable to me.
I requested validation on a citibank debt from asset. they couldn't provide it. they deleted. I even called citibank they had no record of the account. This was 5 years ago. They probably keep better records now but asset didn't even have a printout.
Just a thought. Can you file a case against someone this fast in court. I was under the impression it took sometime to get on a docket. Anyway wouldn't arrow have had to file a legal action during the validation in order to get a summons to her that quickly. If so, would that not be considered collection activity, and hence a violation of the FCRA during dispute? Beating a dead horse....lol
Well Pulse, it sure can be. One must realize that a CA is not going to treat a $7,000 debt the same way they do a $250 debt. In fact, to the precise extent the debt represents serious money you can expect perfect adherence to the law and validation procedure. Don't lose heart just yet. The game ain't over. You are not the first person to accidentally make a mistake. I AM! Please take all these admonishments in the spirit they are meant. To help you. These people on here would not purposely mislead you in a mean way. When I was new, (lol) I read thousands of posts and studied FDCPA and FCRA and a ton of case law. I am just now starting to make some moves. And I'm ALREADY a Financial Planner which gives me a leg up. Take your time and calm down. There have got to be violations in here somewhere. If you owe a creditor money, they have the legal right to collect it. If you choose not to pay it, you run the risk of being sued. Period. There are no guarantees. You sound like one of those people who go water skiiing, break a leg, and then sue the city for not telling you that water skiiing can hurt. Why on earth are you validating debts before you have the protection of the SOL? You were just asking for trouble. You have no one to blame but yourself. You chose not to pay this debt and then took on the risk of being sued. You then chose to validate a debt before making sure you have your defenses in place, and now you woke up your creditor. Duh! Let me tell you why you made this mistake. Because you, like so many others, are obessed with your damn credit report. Who cares? Its toast for years. Get over it and get on with your life. Why are you attempting to get credit? If you are avoiding creditors, why are you messing with it. You should be learning to live without credit. What happened was you forgot all about your main battle, which in your case seems to be avoiding paying this debt. You allowed your credit report to distract you, and now you have been ambushed. So you screwed up. You've lost the offensive. Now what? I've been in much worse situations. My advice to you, and I know that you will not take it, is that you will have to go into all out war with these guys. I don't think you have the stomach for it. When I mean all out war, I mean that you are going to have to become their worse nightmare. You have to become the debtor from hell, the nastiest, most lawsuit happy, and devious bastard they ever had the displeasure to run across. They need to remember you for a long time. Anything less, and you will loose. Guaranteed. I had to do the same thing. I had no choice. I could never pay what they demanded, and was never going to let them screw me over. So I made the decision to make their lives absolute hell. For 4 years I fought 3 large CA's to stalemates over $80k in debts, the SOL clock has run out, and now they have all lost. Ask yourself what your objective is, and if you are prepared to do what it takes to acheive it. If not, then I wish you luck, because you are going to need it. And don't go declaring BK over such a small debt. That would be real stupid. Good luck.

In my case the Texas state law requires it. I don't know about other states, but I assume it is state law.
Since this debt is well within the SOL this might be a good time to contract Bill with Creditwrench. He and his wife did something where they were avoiding a summons. Some kinda way they were able to start sending the collectoin company $10.00 (or something like that ) and I think they get to do it for as long as they like. I don't remember everything, but they definitely avoided a lawsuit and get to pay the debt back at thier leisure.
Change States! When I was younger I routinely changed my address to accomplish my goals. On this one I think it might be something you should look into. I would always legally rent a room/closet something in the State. I only changed my driver license once. It is not required by law that you work in the State where you live so that was never a problem. The other thing I would do is change my mailing address.

If that were to be the case, then perhaps Arrow was already in the process of getting a summons by the time Pulse found this board. That might explain why they were able to validate so quickly. Some statements she made sounded like she was contemplating a lawsuit against Creditnet for giving *faulty*advice. Is it possible that this could have been a set-up of some kind? She mentions in one post that Creditnet should have posted a disclaimer, which someone pointed out to her that Creditnet does in deed post a disclaimer. But her inquiry seemed a bit odd to me. In any case, I find it troubling that Pulse's husband isn't being more supportive of her. Frankly, he sounds like an emotionally distant jerk. Where have all the cowboys gone? Calmest_LA
Where are the interest payments coming from? I thought it was mentioned somewhere that a collection comapny cannot charge interest unless it was previously agreed. If this is not a judgement, then interest is not automatic. Does your agreement detail the default charges?
Re: Arrow Followed FDCPA - I am sad I am not sure what proper service means, but you might want to make sure that they cross all of thier t's and dot all of thier i's. Right now you should be looking for loopholes. Another thing is to consider strategy. I am unemployed and I position myself so I am in a State where the SOL has expired. So.....I feel pretty good about demanding validations. Try getting a new court date while you try to get this thing taken care of. It has been rumored that credit card debt is not valid. Because there was never a loan directly to you there was never a debt/loan created. By signing the dotted line for purchases you simply authorized the credit card company to make payment to the vendor. So....if this is all correct then the original creditor never had any right to sale a debt that was never actually legal. Now, I have a friend who personally has had credit card debts wiped out. A couple actually. Will be happy to help if I can.
Re: Arrow Followed FDCPA - I am sad OK, let's see. Pulse make $7 an hour. That is $14,560 per year. She somehow manages to get credit limits such that she is 2.5 times her income in debt? Get real! I make $65K and I can't even imagine owing that kind of money. I have a best friend who makes $75K and she just refi'ed her house to get rid of $30K in CC debt. She, at least, could afford her bills. If those CC companies gave her that level of credit, they deserve the default! Garnishing that income would net the collector a whole$77 per week. That is a sum total of $305 per month. It would take quite some time to pay $40k off at that rate!
Re: Arrow Followed FDCPA - I am sad cable- Her total debt was $40,000 and her income was $7.00/hour. She had no source of loans to stave off Arrow. As keepmine pointed out, she seemed like a good candidate for BK. But even as I type, so many bright people are deconstructing her story, so none of this advice is useful.
