Arrow/rma Success Stories?????

    Still researching, making sure I have everything covered before I file this week.

    Anyone who has had any successful dealings with ARROW FINANCIAL SERVICES LLC, or RISK MANAGEMENT ALTERNATIVES, could you please post here?

    Would like to know how they deal. Or, "IF" they deal. I have found out today that, after speaking with Texas Secretary of State's Office, they forfeited their franchise status August 25, 2000. I was told that they aren't in good standing.

    If anyone knows their CORRECT TITLE OF BUSINESS AND THE NAME AND ADDRESS OF THEIR REGISTERED AGENT, it would be greatly appreciated. The Illinois Secretary of State wants to charge me $25.00 for this information?? What's the catch on an LLC status as opposed to a CORPORATION status?

    Lastly, how would one find the answer to "are they bonded in this state"? Dancer, didn't you mention something about this?

    wolverine, in some of my research, it mentioned about looking up the "Texas Rules of Evidence and Procedure". Does that pertain to Small Claims or just higher courts?

    I had a 10k account with Bank1 transferred to Fleet, then to Arrow from 1997. All I did was to write Arrow and claim no Knowledge of any account with Fleet and demanded validation and to remove from Ex. To my great surprise 2 weeks later they agreed to delete all the while RMA is playing games with me over a 1996 $300 from Sears. Go figure.

    SEARS is a securred card...it reports as "UNSECURRED REVOLVING"...but in the "FINE" print it says something like "WE RESERVE A SECURITY RIGHT TO ALL MERCHANDISE UNTIL PAID IN FULL"...

    I was able to have 2 CA's agree to remove my account from my credit reports today. FINAL VICTORY! (I hope) Arrow was one of them.

    Arrow ignored my requests for validation for three months so, with my documented FDCPA violations, I took the following actions:

    1) I prepared a formal complaint with the intent to file with the U.S. District Court.

    2) I found their website @ www.arrow-financial.com and e-mailed a Settlement Offer of deletion and $1000 for my damages, including a copy of my formal complaint, to the Arrow Executives.

    3) I followed up with a Fax sent to the attention of Lance Martin, VP and General Counsel for Arrow.

    4) After sending the Fax I called and asked for Lance Martin. He said that he had received my Fax and agreed to delete the account.

    5) I asked for the deletion in writing and I received a Faxed form that was sent (supposedly) to the CRA's requesting that my account be deleted.

    I have not confirmed that it was in fact removed from my reports, but will follow up to ensure that it is.

    I would check out their website if I were you and procede accordingly. I have found that obtaining the e-mail addresses of the Executives of the CA and demanding they cease violating you rights under the FDCPA is very effective.
    The key is whether or not the tradeline is past the SOL, and you have documented Violations of the FDCPA.
    In my case the SOL had expired and I provided well documented FDCPA violations, so Arrow had something to lose and nothing to gain.

    Thanks for the responses.

    I think that I will try to email Mr. Lance with their violations and see what I can get from them. My DOLA on this acct. is 4/1996, so, yes, the SOL is long gone. Let's see what I can come up with.

    Keller,

    I am currently dealing with RMA regarding a PAID collection account from Ameritech (our local phone company). It's only on my EX report.

    After disputing this 3 times with EX, it still remains on my report as RMA continues to verify this account. They openly acknowledge that they do not have the account any longer.

    I called them last week and screamed and hollered on the phone regarding their willful negligence and ignorance for the law and their reply was:

    "...Ameritech told us to put this on your report so we did. Now, if it isn't supposed to be on your report, then Ameritech needs to tell us to remove it.....go call Ameritech and get them to tell us to remove it..."

    This really had me steaming. I told her that it is *their* responsibility to report accurate information, not mine. I refuse to run around and get this straightened out. It is reporting under RMA, not Ameritech, so they need to figure out how to get it removed. Blah....Blah....blah.

    She said she would call me back after talking with the "Ameritech Person" in their office. I have not heard back from her yet, but I will continue to pursue this.

    These people are absolutely ridiculous, but I think eventually they will fold if for no other reason, then for their complete stupidity and lack of knowledge when it comes to the FCRA and FDCPA.

    Matt, Maybe it's time to fax RMA your intent to sue letter. Lizardking had one posted and I've seen it re-posted in other threads recently. It's really good. I believe it might also be posted in the Sample Letters. Let me know how you fare with them.

    I'm not going to take that route just yet because I want to finish my phone negotiations first. Lately I have had some luck just calling and working things thru with some of these people and wrapping it up with a few faxes.

    However, if they still do not cooperate after our next conversation then I will wage warfare with them. The bottom line is they are reporting incorrect information and openly admit to this....I can't believe the level of ignorance within this company. At least most CAs will attempt to cover up their negligence rather than admit to it up front.

    They are a strange bunch of people that's for sure. I'll let you know how things turn out.

    FYI: RMA AND SEARS... took a very, very long time for them to get validation for Sears debt (3-30 day letters later). They will drag their feet until you start threatening to sue.

    Did you settle or what was the outcome of that? I have the Sears/RMA as well.
