I have sat by and watched my dh have to counsel his soldiers for their debt problems. Serious consequences occur such as docked pay, loss of rank, extra duty, and red flagged files....the military does take this stuff rather seriously.

I am calling the attny, of course, most of the time they are hard to get a hold of anyway. I can't tell the creditor we are filing, that will start legal action, I don't know just wiped out I guess! Just plain tired!

I would be scared to sign a new "contract" w/ these people so close to you filing, kwim? If you are hell-bent on filing the bk, it may be best to hand-over the computer/tv.....sucks I know, but that stuff IS replaceable.....I would hate for you to sign this new "contract" and get your bk dismissed for taking out a "loan" that close to filing....I think if I were you I would camp out on that lawyers front door until you get some answers... {{{{hugs to you}}}} and I hope you get your answers!
Re: Re: Re: Re: ASAP creditor showed up at door george, nobody ever said you don't give good advice, you never gave me any at all, until now and it was just to rip on the interest, anyway, I am not taking out a new loan, the loan was originally done in August, they want us to just sign a promise to pay on the 6th of Jan. a payment that is. But we will file on the 5? I will actually read the fine print and make sure there will be no surprises and I will also call my lawyer in the a.m. Thanks kelcol, I know i make it sound like the end of the world and I know it is not there are times that it just feels that way!

As George said most of the interest rates that people complain about are 18.98 to27.98... You never see anyone paying 80% her.. And that was I think the only point George was trying to get at...

DONT sign a new contract; i don't believe those type of loans qualify for discharging under any sort of BK; the next time they come to your house, inform them if they come back again you will call the police for trespassing - and then do so if they come back; wait until your banko is discharged, get a small loan/credit card (secure against your car if needed) and pay them off. they typically can't come and collect your tv without a court order (sometimes judgment) - but check on that for your state. let them report it to your credit report or get a judgment - woohoo! big deal, its not like your credit isn't kind of shot anyways for the time being. ***the best advice i can give is to remember things will only be like this for a short time and things can't go anywhere but up*** Merry Christmas!

The bk filing will come with an automatic stay from legal and collection activities. Sign nothing new. Don't give them any property unless a sheriff's deputy shows up with a writ of replevin which must be issued by a judge. Also, see if your lawyer will file an emergency petition. That's just a bare bones petition and you'll have a few weeks to file all of the paperwork but, it does come with an automatic stay. Just sign nothing without legal counsel.

I did ask her what will they do if DH doesn't go in to sign it then they can not keep it any longer...I said what what will you do send it to a collection agency? She said no they do there own collections, we would just get calls everyday, maybe come to the house and call our relatives....so not sure I want them to receive those calls ya know....if the attny thinks it is o.k. then we will sign it just to stop the calls from going to the family and us...but like I said I will clear it with them first. In a couple of weeks we will have a new phone number and address just from moving so, I am counting the days till this is all over!
