At this point you don't even have anything in writing from the alleged seller, Collect America, whether directly or thru your validation request from the alleged buyer, Asset, to indicate that they sold it to Asset, let alone what remaining amount was due at that time. In addition, you have Astra, which Collect America aknowledges as its agent, which deducted a payment from your account AFTER you were notified that the account had been sold. Where did that money end up? So far, you have nothing but verbal promises from anyone, except for letters from Asset, none of which indicate an amount due consistent with your agreement and payments. (That was what I was referring to with regard to "conversion", if it does not show up as a reduction in the debt allegedly owned by Asset.) Have you talked to your state AG?
Tried calling the AG a few minutes ago, Not getting an answer, telephone problems. Any other suggestions would be appreciated.
After following up with your dispute of their request for more information, you might file a complaint thru BBB. Asset Acceptance appears to be a member, which implies at least a minimal level of responsiveness to consumer complaints thru BBB. Collect America also appears to be a BBB member. Astra also appears to respond to BBB complaints. Do your complaint in writing, against all three, and outline the whole problem, their failure to respond in writing despite their verbal promises to honor your settlement agreement, their failure to provide an accounting for payments made and the remaining amount due under that agreement, and Asset's failure to respond to your dispute and validation request, as required by Federal law. Include the names of all people you spoke to, what they agreed to, and when.
Thanks and will do. On my last and final verbal conversation with one of the astra goons, he told me the man at collect america was going to send it to asset acceptance on the condition attached that they will confirm the settlement agreement. Should I contact my man at collect america and ask him to just send the money back to me in the mail ?
Why not just use it as a tracker to verify that Collect America has properly transferred the debt, subject to the agreement, and with all payments credited, verified by the buyer in writing. If not, and the money has just "disappeared", you have every right to file complaints against all parties, since not only as a matter of law, but in most people's understanding, including BBB and AGs, "just taking money is wrong", more so than failing to validate or whatever. Furthermore, you now have provable "damages".
Met with the paralegal for the new attorney today. She is going to discuss it with the attorney and call me tomorrow. A poster on a different forum offered this (he does despise Asset Acceptance) "Don't waste your time with an attorney. Just go down to the local court and file a small claims suit for breach of contract against whatever party arranged the agreement with you. This is a no brainer. Trust me. Sue for whatever the max allowed in your small claims court. That will get their attention. Don't cookie foot around these people...you will get nothing from them...File suit and I can guarantee you they will settle immediately with you....meaning, they will pay you and make the account disappear."
