I had a credit card with Providian that I defaulted on in 2000 for $591. I checked my credit report last week and the Providian account is listed as a charge-off and there is another entry by Asset Acceptance Corp. with no rating. I have read some of the horror stories on this board re: Asset. They seem to have pulled the same routine on me as well, reporting on my report without prior notice and it says "Unable to locate consumer".

I want to pay/settle this debt and have both the creditor's and CA's entries removed from my report. But I don't know if I should attempt that with Asset or just send them a validation letter. Doesn't Asset usually buy debts? If so, I don't see how contacting Providian to pay would do me much good.

    Any advice?

The FTC opinion letters say that reporting of a debt by a CA is an attempt to collect. Send them a validation letter. They won't be able to validate, of course, then, hopfully, they will send it back to Providian.

Please don't try to negotiate payment with these jerks. That is what they are. Don't let me get started on this. I hate them. Send the validation letter. I have sent them a validation letter and they did not respond. So I sent them an estoppel and they still did not respond. I am mailing my proof to the CRA's today to see what they are gonna do about it. I'll let you know how it turns out. :)

I am in the same boat. How should the validation letter be written?

Look under the sample letter section and you will find all of the validation letters, etc.

GirlieGirl, please let us know how it turns out for you.

I am sending the Estoppel this week, but I doubt that they will do anything. If they don't I will file a complaint with the FTC, and the stat Bankint & Finance office.

Thanks for your input all. I figured that since they seemed to be jerks to everyone else, I would ask before sending anything.

I am drafting my validation letter this morning.

GirlieGirl and BetaCredit, please keep me posted.

    Thanks!

    one more question...

Which address did you guys use for your letters? The Florida street address? Did they accept it?

Ok, maybe that was 3 questions. =)

    I sent mine to:

    Asset Acceptance
    PO Box 2046
    Warren, MI 48090

And yes, they did accept it (too bad for them! Ha!)

Good luck to you Donna, and you, too, Beta!

The more people that complain, the better. :)

Thanks girlie and beta. I sent two certified letters, one to the FL street address and one to the MI street address. I'll wait and see if my green cards come back.

I sent to both addresses and they signed for both. I have not had any reply, but they have till Feb 23td, then I'm going to hit them with the Estopel letter.
