    RE: Account #_________/Original Creditorâ??s Name

    Dear Sir/Madame:

Thank you for your recent inquiry. This is not a refusal to pay, but a notice that your claim is being disputed. This is a request for validation made pursuant to the Fair Debt Collection Practices Act. Please complete and return the attached disclosure request form.

Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some contractual obligation to pay you.

You should also be aware that sending unsubstantiated demands for payment through the United States Mail System might constitute mail fraud under federal and state law. You may wish to consult with a competent legal advisor before your next communication with me.

Your failure to satisfy this request within the requirements of the Fair Debt Collection Practices Act will be construed as your absolute waiver of any and all claims against me, and your tacit agreement to compensate me for costs and attorney fees.

    Sincerely,

    Your Name don't sign

    lbrown,

Can you please tell me the specific reason for not signing the validation and estoppel letters?

I'm going to send some and I was just curious. Won't these letters mean nothing w/o a signature? Won't no signature warrant these letters powerless? And won't the creditors realize this? Thanks.

Some less than scrupulous CA's have been known to forge your sig onto documents. I either use a script font for a sig on my letters, sign and then draw a single line thru my name, or will print the J in my first name - which is not normal for me.

WOW, that's amazing that they would go so far as to actually forge a signature. Okay, I will do what you do. If I used a script font, would that strap me as far as enforcing my letters?

I actually lucked up when dealing with them I spoke with Michael Beach who is there litigation attorney, the collector that I worked with actually told me that they would remove my trade-line well when I sent the check this was written on the for part of the check "for deletion by Barbara Burk" and they cashed the check well the good thing about this was she no longer worked there and I Fed-Ex him a copy of the check and he removed it for me, but before dealing with him, I got no where they are the worst.

Not an attorney, but I can't see how.

No where in the FDCPA does it say they must received a signed validation request from you :)

I was (un)lucky enough to get hounded by Asset Acceptance before I found this fabulous site. They caught me just before the SOL ran out, I thought I got a good deal for 50 cents on the dollar. Lo and behold, the tradeline is still there, "Paid Charge-off". I didn't know any better. :(
