My wife has 3 old accounts (all have date of last 'action') of over 7 years ago. Now they are being reported as "Asset Acceptance" - Consumer recently located. - Date opened 12/01 - (This is when Asset got the account) - Date of Status 9/03 (?) All 3 of the accounts were originally opened with the original creditor (Structure/Victoria's Secret/CitiBank) on or around 1995, last payment on these accounts was 1996. Can I dispute these as past 7 years? How do I go from here? As always, thanks for all the help - you guys know your s.... Brian
Do you know your SOL? If you know that the debts are time-barred, and you also have proof of when the last payments were actually made, then I would send a time-barred C&D. With the CRA's you want to dispute as "Incorrect reporting of Date Opened, Date Closed, Date of Last Activity, and Commencement of the Delinquency; OBSOLETE!" If you dispute only as obsolete, there is a chance that the CRA would base their determination under what is currently being reported. This way if they provide to the data furnisher with the disputes of all FIVE things (the four dates, and OBSOLETE status) you have a specific dispute akin to Johnson v. MBNA. You'll also want to demand a CONCLUSIVE verification under the precident of Johnson v. MBNA, and not a cursory review of only the data furnishers computer records. (Especially since AA doesn't have anything other than their computer records.)
