Asset Acceptance

    AA just showed up on my report. And of course, as others have said before, it says status: creditor cannot locate individual. How nice considering I sent a validation letter to them that they signed for on 4/7/02. They still have 2.5 weeks to go on the validation request, and the collection account is not showing "consumer disputes", but of course why would it?, they claim they cannot locate me.

    So... should I wait out the 30 day time frame only? Or should I wait out the 30 days and dispute with CRA?

    Also, the OC who was originally reporting it as a charge-off has not updated the status, I.E., it still says $X,XXX past due. This should read $0 bal. correct?

    One more thing to add... my score dropped 30 points because of this collection. <sigh>

    I would wait and create a paper trail. They do not comply with the law and they do not provide validation. I've been asking since Nov. 01.

    I am sending them an intent to sue letter next week and then I am filing suit if they don't delete.

    I have filed 4 complaints with them and they still won't delete and they have not provided validation.

    See you in court!!

    Well my 30-day paper trail is barely two weeks old, however they've really ticked me off with that "unable to locate consumer" status. They know darn well where I am, I have their first collection ltr (sent directly to my house), and proof of them signing for my validation letter almost two weeks ago, and they can't locate me? Nice.

    If they do not respond to my validation letter in 30 days I'll have them on 4 FCRA violations and 1 FDCPA. I'm not playing games with them, one more letter and then they'll be exlaining their incompetence to me and the judge.

    I'll be contacting the FTC monday morning as well as the BBB in their (Asset's) city. Hope you are doing the same.

    Best of luck to you if you have to nail them in court.

    I filed with the BBB and they sent some bogus letter saying they are contacting the original creditor to get the documents and they would remove if they don't provide it. That was a month ago.

    intent to sue in 72 hours, this week with a copy of lawsuit. File lawsuit Thurs. if they don't respond. I'm sick of playing with them.

    I filed with the FTC, State of FL and the county consumer protection agency. They haven't responded to the state yet. I will file with the State of MI AG next.

    I've got lots of paper. And their acknowledgement of the validation and estoppel letters in the BBB letter. So it pretty much cut and dry.

    Sounds like you've got them right where you want them. Hopefully someone from AA will get your fax and realize you mean business, otherwise if it's off to court you go, good luck. Tomorrow morning I'll be following in some of your footsteps.
