Can you ask an assigned CA to validate even though the OC is the only entity reporting it on CR as a collection? Also, can an OC during a CRA dispute recall their acct from one assigned CA and assign to another CA? Thanks in advance!! This is my last baddie..and it's recent due to what I think is shady business on their part...now I just have to prove it. Dont want to make any mistakes though. -jkc
Validation under the FDCPA, has nothing to do whether the CA is reporting the account. Verification under the FCRA (since there is no CA trade line to have the CA 'verify') is the only thing which is affected by the CA not reporting the account.
jam... Maybe Ive been in this cubicle too long today...but Ive read your response four times and I dont think Im grasping what you are trying to tell me. I know you can ask for validation from an CA, likewise you can ask for verification from the OC. OC is held liable by the FCBA and CA is held liable by the rest. That being said- in my situation, OC is reporting collection with balance on CR, the CA that contacted me had been paid although they arent reporting at all. I settled with them..had too b/c of mortgage. In anycase, Im still getting billed by OC and all I want is a deletion. But I cant figure out my best plan of attack..hence my question about the val. on the CA...which was a stretch since they are not reporting. Is my only option to ask for verification from OC..? Or dispute to them in writing and then dispute with CRA's and hope they drop the ball?? What , if you dont mind, is your opinion on the best way to handle this. hehe...please excuse me jam...i guess it takes reading it five times or walking away from the computer for my brain to compute...I apologize... Basically what your saying is that they still have to validate regardless of whether or not they are reporting...and verification isnt an option with them since they arent reporting...(that would be the only thing affected by "reportedness". lol...) Did I get it?
