I gave them my last 6 digits of my ssn# and they still can not verify the account. Any suggestions..
Interesting. I had a similar issue with AGL and did the basic stuff for 2 years.. the line remained. then I did the standard verification letter... no response then I did the "silence by estoppel" letter... no response (so that's about 50 days). Then I sent a letter that I wrote... basically stating that "how would they like it if someone asked for proof of a debt/ tradeline and you never got a response?"... I copies the first 2 letters and proof of service and gave them one last courtesy 15 days to remove or get sued. I got 3, yes 3 letters confirming tradeline removal off my Equifax. Now... I know an ex-roommate did the account. It was my social but a mutated name (middle name)... and the account had been paid several years earlier. I was just ticked about the hit to my credit. So... they only had to delete the tradeline. but in your case, if there's an outstanding debt they'll be picky because they'll actually lose the money. If you were never really there (do you know who was?)... I'd never send w-2s... it's way too much info on you and it's an invasion of privacy. Most companies have customers who've had fraud with their ids send an affidavit of fraud.. a piece of paper, notarized, saying it's not them on that account. Ask them for that. If they don't have one... then just fill out a document that states you weren't there... didn't apply for service... didn't use service... and you've let them know the account isn't yours. Sign it and have it notarized. Send them a letter along with this affidavit stating that it's ludicrous that they can provide no signature and that their info doesn't match yours and that, if at this point (now that they know this account is not yours)... you'll now hold them accountable for their actions as willful noncompliance of the FCRA, Georgia Fair Business Practices ACt... etc etc Also, I posted info a day or so ago on the Georgia Office of Consumer Affairs. You can call and file a complaint against AGL and then they can take action for you as well... they really can help you. Put in your next letter that you're filing a complaint with the OCA about them... There may also be a ulitities commission that regulates them... ask the Atty General's office and if there is another regulating dept... file a complaint there too. When they realize you're going to be a real pain... they'll capitulate. But you're going to have to fight them. They're really tenacious buggers.
Thanks, I will definitley do that. 1. Get a notorized letter stating this is not my account. I never had service in my name. I think it is crazy that they can open an account without an signature. But then they want me to sent in all of this paperwork. I just want to resolve this matter. I will definitley report this to the GA Public commissioners office. Thanks
OCA... Deceptive business practices Contact In Ga call 404-656-3790 to start. then send your info into them at GAOCA #2 MLK JR Drive Plaza Level E Suite 356 Atlanta, Ga. 30334 website: www.state.ga.us\gaoca they handle enforcing the Georgia Fair Business Practices Act of 1975. What you're experiencing is not only FCRA violations but also deceptive business practices The Office of Consumer Affairs regulates all consumer reporting agencies in Georgia. They can help you with civil and/or criminal complaints. They help on a case by case basis too
Re: OCA... Deceptive business practices Let me better explain: when AGL puts stuff on your reports... and you put them on notice of dispute... they're supposed to contact ALL affected bureaus and put "dispute" on the item they never do. Also, if you're disputing with the CRAs and they say "verified" but you keep stating that it's in error... they can also be held liable for violations. The OCA can help you with violations by AGL, Equifax... and any other bureau that's giving you issue if you've put them on notice of dispute and you're getting nowhere. File separate complaints... 1. AGL 2. Equifax 3. any other bureau affected and if this office doesn't handle AGL, they'll be able to tell you what office does Takes about 2 mos for them to take action so keep your letters going to AGL and to Equifax et al... add in you've put a complaint into the OCA... that may make them jump more quickly and if not the OCA can help you.
