    I will keep everyone posted on the progress I make with this.

    I agree, Saar, the CRA has the obligation by law to verify any piece of information contained within a consumer credit file if so requested by the consumer. Nowhere in the FCRA does it state specific items - it says ANY information.

    SM: It is important that you find a consumer attorney, one experienced in this area. I know of several suits that have settled out of court for the same infringements. IT IS an FCRA violation when the CRA's release our credit info without a permissible purposes and a violation when a creditor requests this information without a permissible purpose.

    Many attorneys are not well versed in the area of the FCRA and unfortunately can not lend you the support needed. The importance of obtaining a "consumer" attorney can not be overstated. I can give you the names of several experienced attorneys, one I suggest is David Szwak, his number is: 318-424-1400 He is an FCRA expert and has been interviewed on merits/downfalls of the FCRA and consumers issues frequently. If I can help in any way, please contact me. I am currently working on "Consumer Guardian" which will finally be up and running soon and it will deal with assisting consumers in speaking out about various consumer issues as well as an avenue to have our voices heard by our legislators in hopes of strengthening our (extremely weak) consumer protection laws.     If the contract states that the company may make inquiries, is that illegal?

    If the borrower isn't paying, and the creditor reviews the credit file to see if they are paying others, is that a violation if the possibility of inquiries is stated in the contract?

    Current creditors that the consumer has an account with HAVE a permissible purpose to "inquire" into the consumers credit. HOWEVER, companies in which you do not have an extension of credit with and have not given your signed permission to review your credit DO NOT have a permissible purpose. It is those creditors that are in violation of the FCRA and should be held accountable. In fact, if the CRA releases that information to the creditor in violation, they too are in violation and according to the FCRA CAN be held acountable in a court of law.

    After your seeing what a messy screwed up
    credit reporting system we have what are your feelings concerning insurance compaines pulling credit reports in order for you to qualify for auto or home insurance??

    Account maintenance type inquiries are not mentioned by Fair, Isaac-- the defacto ruler of the credit scoring world-- on this page:

    They make a clear distinction that they're referring to "How many recent requests for credit you have made, as indicated by inquiries to the credit reporting agencies."

    Denise, what case law exists regarding this issue?

    Equifax is full of B.S. ...!!!!!!

    Ok... Update for me....!!!

    I have a list of address and numbers to call about my Inquires...... Compliments of Equifax.... I wanted to call these companies before sending them my name, social, date of birth, and my story of fraudlent activity and never giving the authorizaiton. YOU GUYS CAN UNDERSTAND.......

    Only to my suprise .. after talking to the nine different companies, none of the address are correct. WHICH only makes me very MAD!!!

    I did get a confirmation in the mail today from Advanta confirming that the address I was provided by Equifax in fact has been outdated for more than 5 years.

    SO.... I called Equifax today... Talked with Andrew..LOL...!!

    1. I have a FRAUD alert.. why do I have a Hard Inquiry from Creditors Inter. company? I was never notified by mail or by phone!! Please Explain.... Andrew.. put me on hold 2 times.. b/c numb nuts had no clue......!!!!!!!!!!!!!

    I never got a straight answer....

    2. Why did your company send me address of inquires to contact when In fact none of them are correct? I have a letter from a company confirming you are wrong!!!!! Also... Your company instructed me to send all of my personal information, fraud victim, to these mailing address..... GOD... thats how I got into this mess... Someone got my information that should of never had it....!!!!!!!!!!

    Well... Andrew.... ??? He put me on hold ... He come back again. He gave me an address of who I need to dispute this with. He told me to give his name and team number so he could also add to the investigation!! Andrew was very nice and did tell me that I was in the right.. In fact he told me that I should contact the FTC....He said, "Miss, I would contact the FTC If I was you, you are in the right. And.. if I could delete these inquires for you I would. The truth is our Supervisors claim that the contracts with these companies will not allow us to delete inquries.!!!"

    My 2 cents is... After talking to Andrew for 45 mins. an having nothing solved...!!! I have decided to send this to Fraud one last time just to maintain my paper trail. Also, I am sending copies to the FTC and My AG's.

    Do you guys think I should go ahead and start a small claims case with what I have?????? What else should I try to do from here.???

    P.S. I am totally behind SM 110%..... This must stop....!!!
