Attorney that will take them on

    For many years I have been asked my opionion regarding what attorneys that will take on cases regarding FCRA violations. It is often just as frustrating to find an attorney that understands our plight, damages and frustrations and believes in our right to pursue justice.

    I have recently met an attorney who spent quite a bit of time discussing his concern that consumers are not holding the violators responsible for their numerous damaging violations. He is in Florida but can represent anyone in the country finding his own assisting attorney in your area. He is very experienced in litigation and not affraid to stay the course and hold them accountable. He is also concerned with our continually dissapearing consumer rights in that now we must report and pursue a suit within two years of the credit bureaus REPORTING a damaging inaccurate tradeline on our reports as opposed to two years AFTER finding out about it. This means we must continually pay the bureaus for a credit report, do their work and monitor our reports. If we don't, we run the risk of finding out too late that damaging eroneous information is on our report. We may not know of either identity theft or inaccurate information on our reports until we go to acquire credit...two years after errors or "identity theft" has taken place.

    With the Government telling us identity theft is on the rise at incredible rates, this new law telling us we can only hold them accountable in a court of law two years after they place the eroneous information on our credit report places the burdun of maintaining accurate information in our files squarely on us while they continue to reap the benefits without the fear of being held accountable.

    With some consumer support, he is willing to take this on and assist consumers in strengthening our credit rights. In these times of corporate abuse and our legislators demanding corporate responsibility, shouldn't this law be amended to let us hold them responsible putting the burdon of accuracy back on them.

    If I may ask, whatever happened with you and Equifax (if you're allowed to discuss it)?

    Marci: Thanks...Equifax settled the case. I can't release the money but what I can say is that the system itself is extremely aggrevating to put it mildly. The Judge basically siad I had to settle since I had already been "compensated" by the other defendants. I could write a book on how frustrating it is not only holding corps. responsible by enduring all that it takes to get through the years of getting into court but they have what is called "Rule 68" in which if the defendant offers you a settlement and it is more than the jury awards you, you are responsible for their atty fees from the point of offer forward. Additionally, since there were many defendants that had settled out of my case, the Judge can look at what monies were settled for and he can reduce your amount the jury awarded you simply based on his belief you were compensated enough! My lesson was learned in that I shouldn't have settled with any of them and moved forward to trial with all involved!! Of course, I was unaware of this until too late to do anything about it!

    That's really unfortunate. The system is corrupt. But at least, your case did throw more spotlight on the problem with CRAs. I think your effort to fight them has encouraged many people to protect their rights as well.

    and the average lay person is supposed to know how to navigate this crap.

    Unfortunately, that is what they count on....that we can't hang in there long enough to afford the atty fees or the emotional stress and if they don't wear us down, the system itself will.

    Their corporate attys are making their money and nobody is stressed out because it isn't happening to them personally or affecting them detrimentally in any way!
