This is a great Forum and I appreciate any answers or opinions to my question. I've searched the forum and have found conflicting answers to similar questions..... My partner lost his job soon after we purchased a condo together. I tried to carry both mortgages and took cash advances after depleting our savings. In the end the condo was a short sale and I claimed BK because of high CC debt. We are now both trying to repair our credit. I had a CC through Chase and requested a card for him as an AU. I didn't need his permission nor did I need his SS#. The card shows IIB on his report, can he have this removed? The credit history on the card was Paid as Agreed right up until I filed as I was never late with payments so I'm not sure what kind of recourse Chase would have taken against him to try to collect any lates on the card. I realize this maybe a repeat question but any answer is appreciated. Thanks.
As an AU he would never be financially responsible for the credit card, but the history will show up on his credit reports. The best thing to do would have been to remove him as an AU before you stopped paying and filed BK. Unfortunately, there's nothing you can really do to get it removed now since he was an AU when it was included in your BK.
Thanks Joshua, That I should have known especially when my BK lawyer asked me about any co-signers on my loans. I knew he was an AU and not a co-signer but I should have had him deleted anyway before the BK. He was on 2 gas cards too but there were no balances on those cards before I filed for BK. Absolutely, positively incorrect. He was not and is not financially responsible for the debt (account) - it was NOT "his" account. It doesn't matter if the account was/is in perfect standing, delinquent, in default, charged off, or included in a BK -- the AU is NOT financially responsible for it. The AU should dispute it as "not my account". It's not. It will be removed. Chase had/has no recourse to take against him -- he was an AU, and AU's have no financial responsibility or legal obligation with regard to repayment/debt for the account.
I didn't say he was financially responsible as an AU. I just said that the negative information can show up on his credit reports. I agree though- it's definitely worth disputing to see if he can get it removed.
