Hiya peoples! How are ya doing? Oooh, I need a bit of help here if ya'll would be so kind (see I'm such a Texas again!) Anyway, hubby has a collection that was reported to Equifax which we dispute. They never sent us anything but their generic bill with nothing valid whatsoever. Well, I go through the process and get busy with school, etc. and haven't done much with it since November. Now it's duplicated on his credit record ( I know, I know, I know better than to put it off).. so my question is....since I've got the extent with the CA and now they've screwed up and duplicated...would you mess with them? Dispute the duplication (both entries are not valid), or go to AG in Colorado (they are pretty good at getting stuff taken care of).. Thanks for the help! I miss ya'll
Hi Nana! I have missed you! I am glad to see you and in such a good mood. I would think you are in a stronger position now...even though it looks worse. They have screwed up and you can nail em harder for it. I would send disputes to the CRA's for the dupes and at the same time I would send the estopple letter demanding they delete ALL entries because they failed validation in round 1. Tell them if they do not remove them all, you will sue them for far more than this alleged debt they are reporting on your account. Give em Heck Nana! I still use your line, persistence is the key. But I think you have a strong case to get them removed or sue them for a new automatic electronic cover for you new ceement pond....I mean swimming hole. Love ya, Peace, DAve

Not in a pickle...but the only reason to send another estopple would be to HOPE that it would effectively cause them to delete without having to file a law suit. Right now with the validation response you got, and having sent the estopple, you could just file in small claims court for continuing to report this debt without having satisfied your validation requests. If you have all the evidence ready, I would file...if you want to try one last letter before filing, you could send another stronger estopple. -Peace, Dave
