Bad check SOL?

    Anyone know the SOL on bad checks in NJ? Do CA make deals on old bad checks?

    If it is reported to ChexSystems, it will stay on for 5 years. Goto www.chexhelp.com/english/publik/index.htm and order a copy of your report.

    Deal with the CA the sames as if it were a CC. Make them validate, in other words, provide a copy of this bounced check.

    It's a really small amount, so it's worth it to me to just pay it, but not without removal of entry. Can anyone help?

    Ahhhhhh man that is a great question. I have bounced checking on my CR ($70) and I have not requested validation or anything. I did not want to "wake a sleeping dog". I am in Texas. What should be my next step??? It is with a c/a 7-98 is last activity. Should I process as a regular dispute????

    Contact the CA and negotiate a settlement w/ deletion. Make sure to get this in writing.

    I have 2 bounced checks on my TU report($67 & $70). I contacted the CA to try and settle for deletion. They said NO, so I said you'll NEVER get paid! During this time, I've sent 3 validation letters to no avail.

    Have you requested validation?

    So, should I validate first of start the settlement process?? And how much should be the max to pay for $70?? Also, I am not trying to get the five-o to come get me for $70 for that check--are they able to do that ???

    Yes, I would request validation in the form of a copy of the bounced check. The settlement amount can be whatever you want. I might try offering the full amount for best chance at deletion.

    A copy isn't good enough. I have gotten forged copies.
    Settle only for original checks.- they can have the copies.

    No creditor or collection agency that is collecting on a bad check will give you the original. They will provide you with a copy only.

    BUMP:

    OK I just had a CA send me a copy of a check as "validation"

    This check was dated in 97 and the more I think of it the more I am convince that one of my CRACKHEAD roommates used it to forge my signature for a purchase... the amount is $30.. its small but gosh darnit I want this off my credit report...


    should I send a 2nd validation letter ? asking for the original copy?

    also...

    in my 1st validation I asked them to provide all kinds of information but instead they just sent the check..?? how can I get them to fully validate... IE answer all of these..

    5'o won't come and get you. I had a federal agent tell me that with all the homeland security they FBI won't even look at bad checks until they are over $10k.

    If it's been over 30 days since you ask for VAL. I would just send the Estoppel letter & demand the original check in that letter.
    Even if they do come up with the original check all it means is there was once a check.It don't prove any thing is still owed.

    Don't worry about this as you don't want them to do this anyhow.Let the estoppel take care of it.

    Why you need to see the original check:
    I was charged $75.oo for five forged photo copies that bounced.
    How do I know they were forged? I still have the five blank unused never issued original
    checks.

    Wonder why this whole returned check fee racket hits a sore spot with me?It's the other version of check fraud!
    PPS:
    They only have to choices when you demand to see the original check.
    1*Show it to you now or 2*show it to you in court.
