What is the law in Texas for bad checks? Two of my checks were return that I wrote to this small finance company for the month of July totals 200.00 dollars. I talked to the manager today to work with me because my husband’s hours have been cut and I only get paid once a month. So she said she would hold the checks till my next pay day which is August 21. However, she wants me to go sign some paper that I will be on that day? i asked her to fax me the paper she said no she could not do that. I have to go in personally. I looked up the law in Texas and it states a person can be charged for a bad check if they knew about. I really did not think the check was going to bounce but my bank had decided to put a deposit hold which made these checks to bounce. I am wondering if I should go and sign this paper or should I contact a lawyer? I do plan to pay them; I just need them to work with me.
in ohio you have to go to small claims court and sue the person that wrote the check just the same as if you were trying to collect a debt.i know this personally because a man wrote me one for 3000 that that wasnt worth the paper it was written on.i talked to detective,s and they told me with what they know about check,s that they would,nt take one from nobody.check your state law,s, but if it were me i would pay it as fast as possible.yesterday!
It is a civil matter, not criminal. In other words, you need to pay them or you may be sued but, it is highly unlikely you'd be criminally charged insofar as these types of arrangements are unique and really just breaches of contract.

WRONG!!!! Obviously you don't live in Texas nor practice law. If either were true, you would never have given this advice. The laws governing the matter related to BAD CHECKS are very strict in the state of Texas in comparison to other states. The following is an extract of the Texas Bad check laws: It is a misdemeanor in the state of Texas to write a bad-check under $50 for the first and second offense. However, it is a felony to write a bad-check for over $50, or committing third offense of writing a bad-check for under $50 Depending on the type of offense and the number of offenses committed, the penalties under the bad-check laws in Texas start with up to two years in county jail or up to $1,000 in fine, or both, and go all the way up-to to 10 years in jail. I would advise the OP to contact a lawyer, and to do whatever you can to clear this up with the merchant, so that you don't get reported to law enforcement authorities. The wording of the law does not distinguish between "knowingly" writing a bad check and doing it on accident. I don't believe most merchants will file charges, because they are more interested in getting their money than "punishing" you. However, if you give them the feeling they aren't going to get their money, then of course they are.
