I wanted my neck lifted and was charged $4500. in Tx. I ended up with these ugly bands in my neck and he said I needed a platysmaplasty and charged me $2500. more, the bands are still there and I've had two surgeries. I still owe $2500. I charged on a credit card. If his service was not to my satisfaction, can I dispute this charge and win? Please Help!
Yes, you can dispute the charge with the credit card company and you should. But you should also realize that you may lose the dispute and might end up having to pay anyway. While the creditcard company may be very helpful, they may also feel that there is nothing they can do about it. If so you should not let that hurt your credit as well. You should go see a competent attorney and get them to help you with the credit card disputes and with a possible lawsuit against the doctor as well. If you do have to pay the credit card company you need to remember that your credit is worth far more to you than what you might lose if you end up having to pay them. They may help you a lot or even get the charges reversed for you. Either way, a good attorney should be able to help you recover your damages as well.
Re: Re: Bad cosmetic surg. on credit card I'm going to disagree with you kaykay. Ok, sure she can not pay and it'll come onto her credit - that's a given. But legitimately? If you buy a dress and don't like how it looks on you, are you going to call the cc company and say you know, I look fat/frumpy/short in this dress and don't like it. I'm not paying. They'd laugh. She should have disputed the bill with the doctor BEFORE paying it. Her issue wasn't with the cc co. Other shoe, other foot. Shanyl
Re: Re: Bad cosmetic surg. on credit card I must agree with Shanyl. YES, you do have to pay since a service was performed and completed. Cosmetic surgery is not a negotiable, satisfaction guaranteed or your money back deal. (That is why you have to pay in advance of the surgery in cash/credit card.) There are lots of people who have elected rhinoplasty, breast augmentations, lid lift, etc. performed and are not satisfied with the results. When you signed the papers agreeing to the surgery you acknowledged that certain risks and possible complications were being undertaken. If there was negligence on the part of the surgeon, staff or operating room that led to the infection, disfiguration or other medical problems then you may have a possible malpractice lawsuit.
Re: Re: Bad cosmetic surg. on credit card I'm going to have to disagree with the both of you because I don't/didn't disgree with you. I just said the same things in a different way. So for that reason I disagree that we disagree. Now then, do we have to go through a lot of posts arguing about whether we agtee that we disagree that we disagree or whether we disagree that we disagree that we disagree. Just imagine. We can turn this into the most disagreeable thread ever. LOL
Shanyl asks: Errrrrrrr, didn't you say this? I just HAVE to ask - how is this the same? Wait, I won't ask.... I'll just go with the fact that you DO agree with me. Shanyl
KayKay, Thank you so much for taking the time to reply. So just dispute it and then if they say I have to pay it, then just pay it, right? This is such a bummer. When I wanted it fixed in the first place the dr. was cordial, seemly more than competent and experienced, but now that he's scewed it up, he's just like oh, well that happens sometimes. Thanks again, Bekka
Call the credit card company and dispute the charge. It will probably be a dispute for something like quality of service and you may need supporting opinions from other experts in the field etc.... The credit card company will be able to assist you in telling you what documentation you will need to proceed with the dispute. There is no guarantee you will win but it does not mean you can't try.
Re: Re: Bad cosmetic surg. on credit card LAMO That's probably one of the best posts you have ever made.
