ballys collection

    I have a Ballys collection. It will be seven years old in about six months. Should I try to have this removed or should I just wait until it falls off. It is on my TU report and it one of the things that is making the report low. Does anyone have any history with Ballys or collections from health clubs?

    I have a very extensive history with Bally's and their CA, Perimeter Credit.

    Is this debt paid?

    It is not paid yet. I have gotten offers to settle the debt for half, but I did not take advantage of that. I am in FL, does Perimeter do all the collections for them, because that name does not sound familiar to me?

    Doesn't matter if it's paid or not. SOL in your state has run out. They can't (legally) touch you. I suggest you wait out just a few more months, then dispute with CRA's as "obsolete".

    Also, be sure you've printed out copies of your reports showing the DOLA for this account as well as the date it is supposed to drop off, just in case the OC or CA decides to get cute and reage it on you.

    Thanks. And just so I get this right. SOL is the time that a debt can be collected on. Is that right. Also, do I check for the state that I live in now or the state that I got the debt in?

    Correct, the statute of limitations refers to how long someone can legally sue on a debt. Once the SOL has passed, the debt is now time-barred from being collected on. This doesn't mean the OC or CA won't still try to collect, or even take you to court, you just need to raise that as a defense.

    You need to check in both the state you reside in (now) and (if applicable) the state where the contract was created.

    I'm in Florida too with a Bally's on my TU. The CA for Bally's in my case is Financial Credit Corp and after doing some research, Ballys have gotten MASSIVE amounts of complaints. Check out this link, it's full of complaints and other interesting stuff regarding Ballys. From an article in 2001, the FTC had gotten over 700 complaints about Ballys. Please let me know what's going on with your issues. I just sent out my 30 day validation to the CA and recieved a letter back saying they have requested documentation and will forward it to me once they get it. I will of course do a 15 day validation even if they haven't sent me anything.
    Question, if the SOL has expired, are they allowed to continue collection? If not, doesn't that mean that they can't report it to the CRA's since that's considered "collection efforts"? Sorry, just a little confused about SOL. Also, from what date is it calculated?

    We actually just had Bally's remove my wife's account from Genisis Financial CA's. They were actually very helpful in doing so.

    SueDan,

    With all this complaint information you might consider touching base with Bally's directly and asking them to "help you".

    They might very well withdraw their collection file if you sound sweet and hopeless. Don't forget to imply that you want to continue your wonderfull relationship with Bally's. Be sure to talk only to someone with the authority to make decisions.

    I will maybe try that. I don't know though. It comes off in less than six months. I will probably wait until then. I don't want to unecessarily rock the boat.
