I posted in regards to my paid BOA charge off a while back and have been looking for a way to get the charge off deleted. I've tried various letters and nothing works. I recently pulled my three credit reports and all three report different months of when the card when into delinquency. They are 11/06, 10/07, and 12/07. I called BOA and asked them when was my first date of delinquency and I was told 8/08. I told them that was impossible because the card was paid off through a collection agency in 7/08. It gets better. I called on of the bureaus and told them this and they said that BOA stated the 1st date of delinquency was 1/08. So at this point I don't know what to do. Any suggestions would be appreciated. Thanks!
If you paid off through the collection agency. I'm sure they had a bill, or statement you got. Did any of your payments show prior to 1/08? Did the CA you paid report on your CR? What does that say? Do you have a bank statement that shows your last payment date to BofA (not CA)? You need a paper trail. old past due bills. etc.. Have you tried sending the letter to CEO's, CFO, or any one higher up and not just some random office. Google search and call to contact them. create a trail of your efforts. Since BofA is the OC on the account technically they don't have to respond to you demands* for documentations/validation. You may try to get the CA you paid to help you (good luck there) but honestly you paid them they have no interest in helping you. The only angle i see is getting a paper trail and building an Intent to Sue letter for BofA and the reporting agencies. Site FCRA violations and personal grief involved in spending enormous amounts of time trying to correct BofA's mistake. You be filing this in small claims if when you send the ITS letter and get no response. If the CA reported a date you feel was wrong you can include them on FDCPA violations Hopefully someone else with more knowledge will chime in, cause i don't know what else you can do once it's paid.
Yes, my payments showed prior to 1/08. No, the CA I paid did not report on my CR. BOA was the only one reporting even though it was sold to a CA. Yes, I am sure I have the last statement when I paid the CA for BOA. The CA mailed me the letter the last date the account was paid in full. No, I have not tried sending letters to CFO's, etc, but I will give it a try. Thanks so much!
