I had a Bank of New York account that was sold to a collection agency about 5 years ago. I mistakenly settled with the CA for an amount less than the original balance back in October 1997. I started disputing and got the CA off of 2 reports, but it remains on Experian. The Bank of New York remains on all 3 CRA's with a balance showing and past due amount, which I do not owe. I have disputed with all 3 bureaus and it came back verified. I have sent Bank of New York 3 faxes, several e-mails, 2 validation requests, 1 estoppel, and an intent to sue letter. I have not received any response back from them, yet they validate with the CRA's. I am so mad. I have asked for deletion of the account in exchange for not filing a lawsuit, but it looks like I will have to. I have them on several violations of the FCRA and yesterday, they pulled an inquiry on Experian. Can they pull an inquiry (soft) without my permission? What are my chances of winning a lawsuit??
