Bankruptcy and Student Loans

    Good morning, all. About 3 weeks ago I filed for chapter 7 BK. I had gotten myself way in over my head, financially and it was really the only viable option I had left. The reason for this post is because I received a call from a company called CCS. The woman was nice and we talked a bit about my student loans and how much I owe. It's ridiculous. The current amount is around $35,000, 60% of that is interest, I imagine since the loans are so old and have been bought and sold by so many collection agencies.

    Anyway, I want to pay off the loans and try and rehabilitate them in some way. The woman I spoke with was quoting me an amount of about $350/mo for a year to do this. I can't afford to do that amount, right now.

    My question is, do I have to consolidate with CCS or can I contact the Dept of Ed. directly? Do I have any options, at this point? Sorry for the long post. Any help, suggestions will be appreciated.

    Have you checked with your BK attorney? I know you can't discharge a student loan, but you probably should be talking to him.

    I have heard that student loans can be discharged if it poses an EXTREME financial hardship...You have to petition the court and have a good case.

    Yes you are right, and I should have clarified, by the OP's inclination to pay something, I just assumed who wouldn't qualify ( the EXTREME was aptly capitalized :)

    Thanks for replying. I'm not destitute, so I don't know that I would qualify for the extreme hardship angle. I'm more than willing to pay the monthly amounts to get the loan rehabbed, but just not what they are asking. Should I maybe try to contact an Ombudsman or should I try to get the CA to drop the monthly amount they want me to pay?
