Bankruptcy - I'm sorry I filed!

    I live in Georgia and a little over a year ago the IRS found some back taxes I owed because my sister got her hands on copies of my W2's and filed my tax return as well as I did from 1995 and 1996. With taxes, penalities, and interest from nearly 10 years ago, the total from the IRS was a little over $10,000 and instead of telling me anything about it, they simply garnished my paycheck and left me with $600/month to live on. I am single and my family is all deceased with the exception of the evil sister. Because of this, I was forced to file bankruptcy in order to have enough money to live. It hasn't helped anything and in some cases, has made it worse. I have to pay it all back, $600/month for 5 years. On the day my plan was supposed to be confirmed, I didn't make it to court because I had a stroke. The friend that took me to the hospital called my lawyer to let him know and she says he told her he would ask for an extension. Instead, he confirmed my plan. Because of the stroke, I've lost the upper left quadrant of my eyesight..in other words, when I look at a person dead on, I don't see their left eye. I'm afraid to drive because of my blind spot and my eye doctor has tried to adjust my glasses but it's almost as if my eye sight keeps changing and he can't hit a moving target. I ended up quitting my $40,000/yr job because I was so frustrated with not being able to do things that I could before and took a job that pays $10/hr because I thought it would be less stress but it's not.
    I can no longer make the bankruptcy payment and survive too. The lawyer who filed my bankruptcy says there's nothing he can do. Short of changing my identity, I don't know what else to do about my current situation. I am still being harassed by two creditors, who were sent a letter to file a claim against me, which they never responded to, according to my lawyer. I'm so beside myself, I just don't know what to do anymore. Any suggestions?

    Are you sure they just garnished your wages.
    IRS usually levies only after these three requirements are met:

    IRS assessed the tax and sent you a Notice and Demand for Payment;
    You neglected or refused to pay the tax; and
    IRS sent you a Final Notice of Intent to Levy and Notice of Your Right to A Hearing (levy notice) at least 30 days before the IRS levy. IRS may give you this notice in person, leave it at your home or your usual place of business, or send it to your last known address by certified or registered mail, return receipt requested. You may ask an IRS manager to review your case, or you may request a Collection Due Process hearing with the Office of Appeals by filing a request for a Collection Due Process hearing with the IRS office listed on your notice. You must file your request within 30 days of the date on your notice.

    In the alternative, have you considered a Hardship discharge?

    This involves converting your case to a Ch 7 and then filing a motion for a hardship discharge based on circumstances outside of your control.
