I filed for BR in 1996. However, I withdrew the petition before the court date and it was not completed. All 3 CRA's list it on my credit reports. Does anyone have a sample letter I can send to the agencies requesting it be taken off my credit report. Sincere thanks!
A BK will stay on your report for 10 years for a chapter 7 and 7 years for a chapter 13. Even though you didn't complete the BK it will remain on your report for the alloted period of time. You may have a chance at disputing it off, but there's no point in asknig the CRAS to remove it simply because it was dismissed without discharge.
Yeah. Whatever you do don't write them a letter stating that this is YOURS but please take it off the report. I'd recommend disputing as "not mine", and perhaps others have recommendations. I've heard something about disputing on the basis that each bit of info is not 100% correct, which it typically isn't (for example my own BK7 was not zero assets and zero liabilities as report by CRA.)

In my days of lack (of credit intelligence and money) in desperation - I filed and then voluntarily withdrew my Ch 7 petition TWICE. (1995/1996) Here we are in 2004 and my '95 on all 3 CRA's just came off and my '96 has fallen off of one CRA. That said, my DH has had neither of them fall off of any CRAs. I did recently receive a letter from TU that stated that if the BK is voluntarily dismissed (regardless of the chapter) they will remove it after 7 years. Gee thanks right? Anyhow, you're at about the same time mark I am... give it a shot - dispute as not mine.
If you actually did file the bankruptcy though, wouldn;t it be fraud to delcare "not mine?" My CR lists Ch7 BK in NJ in 2003, but I have no previous address in NJ on the report. Also says $0 assets and $0 liabilities which is erronous as well.
That's the whole point - the information has to be 100% accurate to be on your report. Was your bk 0Lib/0Assets? So just because this file shows your name and case number doesn't make it "yours". No fraud, factual. You've not saying that you didn't have a bk, just that this as represented isn't yours.

Re: Re: bankruptcy removal from cre If this was a personal BK, you might want to review your paperwork again and determine whether it was a Chapter 7 or a Chapter 13. Chapter 11 only for a business reorganization. That's why this TL is "not mine". You didn't file a Chapter 11.
