removing bankruptcy not proceeded with from credit? Hi, this is my first visit here, have a question. I had some problems on a divorce issue and started bankruptcy proceedings but all was worked out and wasn't necessary to proceed. I did not proceed with the bankruptcy but it shows up on my credit report, can I legally request them to remove it? Thanks for any assistance Barbara

I have to go through this long process of explaining everytime I want a loan since it shows up on my credit report. thanks again barbara

Re: removing bankruptcy not proceeded with from credit? Yep, shouldn't be any problem, especially with the documentation from the court. First, make sure you have a copy of all three reports that are less than 90 days old. Then give a call to Equifax, Experian and Trans Union and get their address for disputes and documenation (don't have them handy atm). You should be able to initiate the dispute over the phone, if you'd like--but you still need to send the letter. Send them a letter (certified, return reciept), like the "dispute debt" letter in the sample letters section, add a paragraph mentioning that you've included documentation and viola--30 days later it should be gone(*). -- cnswift (*) Sometimes it's not this easy, but usually when you send documentation like what you've got, it is. If it doesn't fall off like it's supposed to, lots of folks here that can help with the next steps.

Re: removing bankruptcy not proceeded with from credit? You don't have to start a dispute when you call--the letter by itself is technically enough. I normally start the dispute online, or by phone, and then send the letter the same day. That way the 30 day period technically starts immediately, as opposed to when they get your letter a few days later--I just make sure and mention that I'm writing in regards to a pending dispute, and if they have no record of a pending dispute that they open one immediately. And, since you've got documenation you've got to mail in anyway, the letter makes a nice paper trail if you ever have to take them to court for failure to remove inaccurate information. -- cnswift
Re: removing bankruptcy not proceeded with from credit? Just the fact that you filed a bk petion is enough to keep it on your credit report. It doesn't matter that you didn't follow through. Hopefully, you'll find someone at a CRA that is sympathetic but, I doubt you'll get it removed. It 'll stay for 10 years .

Re: removing bankruptcy not proceeded with from credit? Wow, my Mom backed out of her bankruptcy a few years back and didn't have any trouble getting it removed in dispute. I knew it appeared as soon as you filed, and that it would stay even if the judge denied it, but I didn't think it would stay if you decided not to go through with it.
