I need to know after you paid your Attorney signed the documents for a Chapter 7, how long after that should I received a letter letting my know of the 341 Meeting with creditors.
We paid our att. in Aug. of 98. Unknown to us he didn't file until Dec ( he had other clients and wanted to file everyone at same time ) Once he filed on Dec 9th our meeting was Jan 12th-- Discharged 3/99. We paid our bills until July 98 and because he didn't file until Dec. we ended up with accounts being charged off before the bk, which Exp. continues to report along with the bk. Anyway, I would suspect that when your att. files you'll hear from the court in a few weeks. At least that was our experience in NJ in 98/99
I filed in May 2000-got my 341 meeting with creditors letter 3 weeks later and went to court June 6. The bk was discharged August 2000
I filed in early June of 2002, went for my 341 three weeks later and was discharged in early September.
My sequence: 1) Met with attorney who filled out paperwork and paid in full on August 27,2002. Already had an appointment scheduled for that day several weeks in advance so he told me what to bring to 8-27-02 mtg. 2) Atty filed (online) bk paperwork on 8-28-02. 3) received a letter from the bankruptcy ct 9-6-02 saying 341 mtg would be 10-2-02. Same letter went to each creditor and started automatic stay. 4) atttended 341 mtg on 10-02-02 5) bk discharged on 12-3-02, received paper copy of discharge 12-6-02. My understanding is that the timing varies from up to 45 days between your actual discharge and receiving the paper copy. Hope this helps.
No...I don't think that's normal. I'd be on the phone with my bk atty today or Monday at the very latest. Hopefully, you're not dealing with an atty like gatorarts: <We paid our att. in Aug. of 98. At least that was our experience in NJ in 98/99> If you find out this is the case...that s/he's causing unnecessary delays, I would try to get their office to refund your money. After all, you're paying partly for the value of the automatic stay. Did your atty mention that s/he would handle the calls from the OC's and/or CA's for you?
Yes, he gave me the number when I paid 1/2 of my fee. I think I would give the office a call on Monday. I guess my case is a little different because I am converting from a Chapter 13 to a Chapter 7. (this is just a guess)

I think, by and large, unless you can prove really signicant hardship, most attorneys are not permitted by (I think) Federal Law to file a C7 for whatever reason until the atty is paid in full. At least that's what my filing for US Bankruptcy Court for the State of DE says. Good that he's taking any new collections calls from your creditors at least. Good luck to you.
