Being Sued by Cap One.

    Hello All, I am new here. I recently received a civil complaint to appear in court. It listed Capital One as the Plaintiff. I notified the court of my intent to defend, they told me I will receive a new date in the mail. I think that I am actually being sued by a collection agency. I would like to make a motion to dimiss based on the fact that the wrong plaintiff is listed. First off I am not sure who the actual plaintiff is. Sorry for being drawn out. I really need help on this.

    Hello, and welcome. Can you explain why you think the wrong plaintiff is named? Cap One may just have a law firm suing you on its behalf. What's the name of the CA?

    Joshua is right, as usual. Cap One usually keeps the debts and just hires someone to act on their behalf, so Cap One is actually the one suing you.
