Being Sued by Citibank

    Hello All

    I could use a little help, I was served on 6.27.2010, Citibank is listed as Plaintiff. Attached to the Summons and Complaint is copy of the complaint and Notized Affidavit dated 3.31.2010 as well as a copy of my 12.15.2009 statement.

    The summons says I have 21 days after receiving this summons to file a written answer with the court and serve a copy to the other party or take other lawful action with the court.

    What type of written answer do I give? I have done some searching this morning but got confused over some the answers.

    To be completely honest I buried my head in the sand on this one, I did not send any letters when the collection notices came - last payment I made was 5.29.2009. I was going through a nasty divorce - wasn't awarded any child support and currently can't keep my head above water.

    I am currently in first stages of BK 7 - I need to attend my 90 min credit class so I can file which I hope will before the end of this month.

    But I am at a lost for what to do with this. I know I can't ignore more I don't want a default judgment but I can't pay. Any suggestions?

    How you answer is determined by your local court's rules. Try to research some cases from the same court. The clerk of court can't help you with the answer but in some places they can give you samples of formats.

    If you're filing bankruptcy, your first stop should really be your attorney's office. Ask him or her for the proper steps.
