Being Sued by Weltman Weinburg & Reis

    Exactly as the title states, I am being sued by these greed bags and I live in Ohio. This is a very corrupt institution. I agreed to pay them monthly and did so for 3 months. Then one day they call and offer up a $7,000 settlement on a $9,500 unsecured business debt. I declined and said I will continue making payments. They did not like this and cut me off. A year later, they send the post man to my door with a letter from my Warren County Ohio Court. So I just received this letter on Thursday, 3/15/2012. Now What do I do? I do not have a job, and have no assets. I do have a truck, but I owe $20,000 and it isn't going to be paid off for 2 years. My wife has a job earning 6 figures, and the house is in her name. Am I judgement proof and should I have my wife put a lien on my my truck? (if so, how do I do this, and then how do I have it removed?) My wife opened a new bank account in her name, and left our old account open with no money in it. I also, have a checking account of my own that has .56 cents in it. I seriously am becoming depressed over this, I have had these collectors call the police on me for telling the collector to wear a weltman weinburg and reis shirt and go shoot herself in a public place. The police officer said he just had to follow up, and said not to say anything violent to them any more. I told him, I have had it with them and he said he understands just yes them to death and stay positive. Thank god he didn't want to take legal action. So can anyone help guide me in the right direction. I do not want to pay a greed bag lawyer and I do not want to file for BK. Please help, I have limited time and need to figure this out ASAP. I am seriously losing sleep and becoming depressed and full of anxiety. I want Weltman Weinburg & Reiss to go pound sand, and fight them in court, what do I do?

    The first thing you should do is answer the summons. You can't let them win a default judgment. Your wife has assets, which means they might be at risk too. How much of the debt did you already pay when you were making payments? Did you have some sort of signed agreement for the payment plan you were originally on?

    I know this is stressful, but try to take a few deep breaths and just remember that this too will pass. Take it on one day at a time.
