I am being sued by a collector called HLBC over a debt which I don't believe I owe. Although they initiated the suit last month, I was served only last week, ten days before I have to file an appearance (this Friday.) And, I am apparently required to pay an "appearance fee" to even have the right to dispute this debt. This seems very unreasonable, as it gives me no time to pay this fee or to make arrangements to be in court. Is there any recourse for a continuance or anything like that, or should I just resign myself to a default judgment being issued?
I'm not a lawyer, but it sounds to me like you're going to want one to help you through the process. You will have to pay an "appearance fee" because that's how the court system sustains itself. Everyone on both sides has to pay fees. And generally the plaintiff has 30 days to serve you after they file suit, and then you just need to respond by the return date. You don't necessarily have to be in court by this date, but you just need to file your appearance form. Once you do that, then you will get a court date at some point in the future. Don't give up and just resign yourself to a default judgement. That's the worst thing you can do, especially if you truly believe this is a debt you do not owe.
