BIG PROBLEM!! Please help

    A bank refuses to change the DOLA after they have provided me with written proof that they are reporting it incorrectly to Equifax.
    I sent this info to EQ and they wont do a damn thing.

    They say that the DOLA is the written off date, when it states on the EQ website that the DOLA is that date I made the last payment (delinquency date)
    Any ideas on what I should do?

    Write them a letter and tell them you are about to file complaints with the FTC, FDIC, AG, BBB, and anybody else you can think of:

    Sec 623

    5) Duty to provide notice of delinquency of accounts. A person who furnishes information to a consumer reporting agency regarding a delinquent account being placed for collection, charged to profit or loss, or subjected to any similar action shall, not later than 90 days after furnishing the information, notify the agency of the month and year of the commencement of the delinquency that immediately preceded the action.

    There are also several good opinion letters that make it clear you are correct. You can always attach copies of those.

    Then, I would send another letter to EQ, that they are reporting incorrectly, here is the proof, and this blurb from the FCRA.

    4) Consideration of consumer information. In conducting any reinvestigation under paragraph (1) with respect to disputed information in the file of any consumer, the consumer reporting agency shall review and consider all relevant information submitted by the consumer in the period described in paragraph (1)(A) with respect to such disputed information.

    Threaten to sue them.

    Sweet victory!!!

    Well I decided to get mean with these jerks and called the Banks Ombudsman and lodged a complaint quoting the laws that they had broken, well a mere 2 hours later I got a call saying that 2 of the accounts wouls be corrected! YAHOO!

    I will have to work on the 3rd one as it was a bank account that turned into a demand loan and there was never any activity on it...only $800 so if it goes no where I might just say "hey delete and I'll pay"
