A neighbor of mine said a guy stopped by last week looking for me. He left his number 800-801-9403. Would a bill collector actually have the nerve to come to your home??? Anyone want to call that number and find out who they are? Thanks - Ken
I've had a collector from a finance company come to my home before. I don't know what he was trying to accomplish. I didn't have the money when the company called, his showing up in person didn't change that fact.
What did you tell the guy, or did you not let him in? What is the attitude like when they show up? I just moved on Sunday and I won't be giving them the new address <lol>
How can I send them a CRRR when I don't know who they are representing, and haven't heard anything since? I did find http://www.gcserv.com, but that's about it. Why would they visit?
GC Services is a CA. I have had them attempt to collect magazine subscriptions that my kids signed up for or for Columbia House crap. I have never paid them a nickel and they never came by my house.
if you have too many debts it's a crap shoot to figure out who they'll be collecting for. THat was my experience anyway LOL but I have heard of visiting bill collectors, and I'd be fairly certain that whomever this GC services is, they probably bought the debt, and it;s probably a heavily sized one at that for them to actually come over. Won't make them collect any easier though. No cash is no cash, right? I'd be interested in knowing if he told your neghbor he actually was a debt collector. Isn't that a violation of the FDCPA? Same as when mailing, putting ANYHING on the outside of an envelope that says they are in the debt collection business. hmmmmm...may have something here! Didn't u file for BK Ken? Or at least I thought you were in the process of doing so a few mos back. If that's the case, then there is nothing he can do as long as the debt is included the the BK filings. He'd have to contest it on your court date, not in your yard.
I called them and found out it's American Express. They guy on the phone was very nasty and threatening. I told him I was meeting with an Attorney and he said "Oh, so you're pretending to file for Bankruptcy". He told me either way, I'd be punished. He was VERY rude and nasty. I ended up hanging up the phone. He was sure to tell me that American Express has a verified claim against me, whatever that means. I'm going to have to retain an Attorney REAL quick. Ken
<bump> I guess this was my first serious call from a collector. Do they typically threaten you and call you a liar? This guy told me I was going to be "punished" either way (filing or not). I've been sick over this since last night. I have an appointment with an Attorney tomorrow. Just looking for moral support. You guys are wonderful! Ken
Yes he came to the old address. Then using their "skip tracing" techniques he called my parents, who relayed the message. I called them back and that's when the guy started harassing me and telling me I wasn't going to get away with it and that I made "all those charges" thinking I wouldn't have to pay for them. He also said "you don't pay your bills" and that I was pretending I was going to file Bankruptcy because I couldn't give him a lawyer's name. Last time I checked, you didn't *need* a lawyer to file Bankruptcy, albeit silly not to, but... The balance on the American Express account is around 3,500.00, so it's not like I'm stiffing them for 20K or something. I also called Amex who told me there was nothing they could do as it was in the collection agency's hands, and they wouldn't even tell me if they were still the creditor. Ken.
Is this debt within the SOL for collection? Has the CA made any entries on your CR's? You need to start building up your "stockpile of ammunition" against them The FDCPA says that within 5 days of initial contact with you (the phone call) they need to send you a letter with their claim and the "mini-miranda" Have you received anything from them? You might call them from a payphone, or firend's cell phone who wouldn't mind and ask them when they answered "what is their address to send legal papers?" Then send them a validation letter...see examples elsewhere on this site to that address by CMRRR
Re: Re: Bill Collector Visit? Hi, Ken! When you do finally meet with a BK lawyer to file your BK petition, list both AmEx and this collection agency as creditors for this particular debt. Doing so ensures that both of them get the message that you've filed BK. Until you do file, as Butch suggested, memorialize that conversation with the nasty CA. Re: Re: Bill Collector Visit? hey Ken, don't lose any sleep bud it ain't worth it. trust me and all those whom have been in that boat! there is NO law that says u have to call them back, or talk to them. u did it as a courtesy. if that call was from a CA, then u need to document it all. I'd like to think the guy you called violated several FDCPA statutes by his treatment of you, but that's nothing unless you recorded the call. when you meet with your attorney, u'll be further along the path. Once you have retained the attorney, the CA and OC are not allowed to call you if you request they not do so, as long as you supply them with your attorney's nm, address and phone number. Hang in there, it gets better!
