BK 13 list 2 doc # on CR ...

    Hi George...

    I have read alot of your post on here and they are very informative. New Jersey is infamous with surcharges and MVA. My surcharge was for hitting a telephone pole approx 20 years ago (fell asleep behind the wheel). I had to pay for the pole ($4100.00) and of course, it was put on my CR.     GEORGE-
    There are some states...nj being an infamous one...that have an uninsured motorists insurance pool. The way they fund this pool is to charge people who were convicted of traffic violations....from speeding to DUI...with huge insurance surcharges. Depending on how many points you were charged they determine a surcharge amount. My daughter who is one lousy driver right now has $3,780 in surcharges in NJ. Fortunately for her she lives in Vegas now (do I hear jealous noises coming from UNLV???!!!) and she got a NE driver's license. So the only recourse NJ has is to ding her CRAs...it is an arbitrary and unfair system that penalizes people who have valid insurance to pay for the claims of people that don't...in 2 words...it sux!

    UNLV...I would dispute the dismissed bk with all three at once. They don't communicate with each other so it really doesn't make a diff. I hear Equifax is the toughie about removing bk 13s...so pay some special attention to them. Go after the dismissed bk as it is the one that would hang around for 10 years...As for your judgment...in order to prove the exact amount you're going to have to write the court and get the paperwork from the case. If you get the paperwork and we can take a look see at it...we might be able to see if they did anything wrong when they filed it (I'm assuming it was a default judgment). But the amount they sued for will be in those papers.

    STATE MANDATED EXTORTION???

    This is on top of what was paid to the court and the injured party and the insurance company PROFIT ACCOUNT??? AND INCREASED RATES???

    I am in the process of writing dispute letters to the CRA's as we speak. I will call the court and get the judgement info this week. Should I send them CRRR?

    As always, you are ON TOP OF YOUR GAME!!!

    Yes, I am jealous...I admit it :eek:)

    Definitely STATE MANDATED EXTORTION!!!! That is one of the reason why I left Jersey. The auto insurance rates are outrageous because of the surcharges, auto theft, and uninsured motorist...

    Any advice on which dispute letter to use on here? I am looking in the sample letters list. Or is a better letter floating out here somewhere that is better suited for this type of dispute?

    Always send CRRR...and keep good files and records as you might need them later.

    In answer to your questions:YES, YES, YES...the surcharges are over and above your premium increases, fines and whatever. That is why people from NJ commiserate about the infamous surcharges...and nj is the #1 most expensive car insurance in the country. It made my decision to move across the Delaware to Pennsy really easy.

    CLC, Any advice on which dispute letter to use on here? I know what you mean on surcharges, I got the hell out of NJ quickly... I will tackle the MVA tax lien (surcharge) after the BK outcome. We are not too far apart if you are in PA, I am in MD ...

    If you can wait I will try and wordsmith one for you tomorrow. I am assuming you want the dismissed one gone and leave the discharged one...so with that in mind I will get one together for you in between the raindrops (a typical Monday in a law office...the clients have 2 days to think of reasons to call us...lol).

    PS I used to own a condo in Rock Hall, Eastern shore not too far from Chestertown...love the Chesapeake Bay...and boats (Sea Rays...too rich for my blood now ;={{)!

    Then it would PAY BIG-TIME to live in ANOTHER STATE OTHER THAN NJ AND COMMUTE...(if you worked in NJ)...even if it was one hour each way...

    That sounds good. I can wait another day. Thanks for all of your help. If anything else is added to my CR by tomorrow, they might as well staple the info to the rest of my CR ...lol

    Too rich for your blood? My parents still live in South Jersey (Newfield), so the only advantage is its the country. They are paying killer insurance, but not as bad as some counties in North Jersey. We both got out while the opportunity was available. I wish you and your daughter success with her tax lien. As mentioned previously, I will try to tackle that in the near future.

    PS -- One day when I grow up and be like CLC, I am going to buy a big house in Potomac, MD. Until then, I will just have to try and fix my credit and stay in Montgomery Co ... :eek:)

    It definitely pays to live ANYWHERE besides NJ. It is a good state to visit, but terrible to live there ...

    My parents still live there and they are moving to MD when they retire next year. They are fed up with NJ ...

    I'm so sorry...I resigned my job and moved to FL just arriving late Monday nite. I have been somewhat out of the loop here but am back to check in once in awhile. BTW I am a busy WOMAN...I will reread the thread and do my best to make good on that letter.

    HEY CLC!!!

    Welcome Back...how is your Bar Exam studying comming along? As you can see, we definitely missed you on this board (especially me). I can understand with our personal obligations. The way I see it, these 2 BK13 are scheduled to be on all 3 until 2009, so I am VERY APPRECIATIVE that you as well as others have chosen to help in this matter.

    I am waiting until CHOD to dispute the BKs, Tax Liens and Judgements.

    I am just getting one more band of disputes with all 3 before CHOD...

    YOU ARE DEFINITELY THE WOMAN :)

    There is a thread on getting bks off your CRAs which was posted by a new york guy that had some good ideas and some downright felonious ideas (like counterfeiting court documents). Sassy and I and a couple of others found the felonious side to be somewhat objectionable...we agree that we need to beat the CAs, OCs and CRAs at their own game but we don't want to spend jail time using illegal methods to do it.

    But he did outline a way to use a new address in order to disassociate your bks from your file that I thought was creative and not illegal. So let me try and find the thread and you can read it...as a big boy I'm sure you will be able to delineate the black from the gray and white.
