BK accounts/ DOLA- Experian

    Seems that Experian states that any account, included in a bankruptcy and trade lined as such, will reflect a date of status which is the same as onesdischarge date.

    That's what the rep told me today. EQ and TU show the date that the account defaulted. Why are they such basta**s?

    I've searched the FCRA and all I come up with is:

    (1) Cases under title 11 [United States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years.

    Not very specific.

    right below it is:

    (4) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years.(1)

    (1) I interpret as the Public record listing. That I cannot dispute.

    I would consider a TL referencing an account, not the case number specifically. Since they also list my BK 7 accounts with remarks that include the terms "charge off" or "Bad debt", why is the date of status not the delinquent date? I see their logic and naturally, I don't like it!

    They are only interested in keeping my report as negative as possible for the longest time possible.

    I'll have to research "their" interpretation" with actual law.

    Anyone suffering the same fate?

    All my IIB's have my filing date as the DOLA. That's when they were discharged. I don't see a way around this, if you did include them in your BK - they've been discharged. There's a big difference between that and a chargeoff, they can't bother you about it again. Well, they can and you can tell 'em where to go and not worry about it - unless you've reaffirmed the debt in some way, like taking one of these foolish credit cards. I digresss...

    Look, I don't mean to be harsh, but your BK is there for ten years from the filing date. All of your IIBs come off three years earlier. And after some time passes, it's not hard to get them off. It's a better deal than the ten years for BK.

    You want to hear about a raw deal? Try tax liens. I have a tax lien that was filed in '92 and although released in '92, the only document I could get was a re-release this year. So I've got seven years from NOW before it falls off. Great!

    The little I've looked, the date is the Discharge date.
    I must be lucky with the other CRAs as they have DOLA 2 years prior to my discharge.
    I have some reaching the 7 year mark in 04 and 05. Guess I'll leave well enough alone.

    all my 7 negative accounts have DOLA 5 years prior to the dishcarged date and most of them says iib and some of them still says charge off after disputing several times even though it was listed in the bk.

    David,
    It stinks. Every time I straighten out one CRA, another messes it back up. I disputed a iib and they verified it by changing it to a charge off with a 1300 balance!
    It's a vicious cycle that keeps the Post Office busy.

    19 years for a 7 year item: This is what the scoring and reporting racket is set up for so they can con folks like this.
