Re: Re: Re: Re: Re: bk/charge-off I understand. believe me I do. I don't have that kind of fight in me. I see your point but do you see mine? That chase account went bad in 1997. You only had 6 more months and that account would be gone from your file. Did filing bankruptcy benefit you at all? CA's and CRA's are in bed together. One depends on the other for their survival and continued cashflow. That's why this board is so important because it gives you the tools to fight the machines. Now what if you fight and still lose? Then what? You still have the 7-year law. Which, as it applies to you - would be only 6 months! Do you see my point?
Re: Re: Re: Re: Re: Re: bk/charge-off Yes, but the OP's question specifically addressed lying to the CRA's about accounts that we know belong to us (NOT accounts included in BK's). Is that ethical? believe me I sure lied to them because they lie to us. But I think the OP posed a valid question and I see no one has a answer for him because we are all guilty of advising newbies to lie. The irony of it is I am vilified for doing what I felt had to do which was basically lie and uphold my rights to have my record wiped clean.
Re: Re: Re: Re: Re: Re: bk/charge-off Did filing Bankruptcy benefit you at all? Chase probably would have sued me at that point. Then a judgment, then SEVEN more years on the report. Judgments in my state are 10 years and they can be renewed. TEN more years.
Re: Re: bk/charge-off Why are we fighting with each other over this post? (Or even giving it the time of day?) I am suspicious of who this poster even is (the mysterious TU monitor from another thread??) -- we are all here to fix our unfortunate circumstances, be it a handful of lates or a BK. I think most could do without the judgemental attitude. When disputing "not mine" we are merely exercising our legal right to ask them to prove the debt. Granted, it's a game. But it's their game -- we're just showing up to play.
Re: Re: Re: Re: Re: Re: Re: bk/charge-off I doubt they would have sued you. Do you think they drag everybody who defaults on a loan into court? For how much, a couple thousand bucks? The attorney fees would be very expensive if they did that. No I think they go for the easy money: They bluff. I had a car repo, student loans, credit card debts. No one sued me. They were probably bluffing. I probably would have taken the bait too if I had gotten their harrassing letters and phone calls. Who knows.
Re: Re: Re: Re: Re: Re: Re: Re: bk/charge-off I had 3 judgments before filing around 13k on those 3 and I tried to work it out. I had my paychecks garnished at 25%, they wiped out a checking account and it was rent money. Was that a bluff?
Re: Re: Re: Re: Re: Re: Re: Re: Re: bk/charge-off In your case I can see that bankruptcy was the only recourse to get those sharks off your back. It's a shame that even with the BK, they are still harassing you. Can you get an attorney after them? If you can't afford one they have legal aid services in most cities.
Re: Re: Re: Re: Re: Re: Re: Re: Re: bk/charge-off SoParkDiva, I can handle it myself and will, thank you though. It is just my personal situation. Everyone here has their own personal situation and they ask for advise here. In your personal situation, what worked for you was a good thing. Yes I see your point. Giving advise to others on what you did that worked for you is bad advise to others in most cases. Just like if I told everyone to do what I did in my personal situation it would be bad advise because their situation might be different. That is why you have to read what they are actually going through at that time. I have seen "newbies" here lately getting bad advise and I could step in if I have been there. If I am wrong than a "pro" or "vet" may jump in and the origanal poster will get great advise. Good luck SoParkDiva.
Re: Re: Re: Re: Re: Re: Re: Re: Re: bk/charge-off ok so now my question is if i have already disputed as bk with ,experian only, can i now go back and dispute not mine since they were not corrected, correctly? i did this in the first part of june. is it too soon to do it now. thank you
