Hi, Thank you in advance...you all are wonderful! My BK was discharged on 6/22/04. (I know it is really a short period of time) Of course, due to the short time frame my report is not updated. I have disputed with Equifax about the dicharge and have started an investigation. They have already confirmed the discharge and so has one other of my creditors. I only have 6 tradlines. My question, if they do not report everything(it was all included) as discharged..which would show I still owe the debt. Can I fight to have the items removed from my report? I am concerned becase...just as luck would have it, I have a Judgement from an apt 11/97 that is scheduled to fall off. I need desperatly to have this disappear by the end of September. I am seeking new housing. I have disputed all items as not being reported correctly and discharged in BK. Is it up to the creditors to report the discharge or is Equifax responsible to make sure it is correct thru the BK court?? I sent my discharge paper in to them. My investigation started 7/9 so they have 30 days to correct this right?

I hope this makes sence. My head is spinning at the moment. I am just so close to having my report where it needs to be. I am under time restraints to move.

Thanks to all for your help

    Abby

I waited 2 months to let things settle down and hit the Bureaus before I started credit repair.

Only 1 company did not report correctly....First USA....which reported a discharged account as a charge-off with a balance.

I sent a letter to them basically saying that if they can not provide me a bill for the balance they reported to the credit bureau, then they must either remove that tradeline or it will be acknowledged that they reported false information in violation of the FCRA.

One month later, I got a letter saying it was fixed to show Included in Bankruptcy with a zero balance.

I didn't get it deleted but at least it is fixed correctly.

1*Judgments report for 10 years so this isn't due to fall off till 2007.
How did you get it will fall off soon? Also if they renew it, it can report for another 10 years.
2*You just glued the BK to your reports for 10 years by doing that. Now how are you going to get it off?

May I ask what you mean by this??? I just got discharged and have heard NEVER send the BK papers, but what do you mean by "glued" to your report for 10 years? Explain please?

If you submit your bankruptcy papers to a CRA, that is an admission that the bankruptcy is yours. While they can report for 10 years, it does happen that they don't. Or they misreport in a way where they can be removed.

However, if you affirm that it's yours, you're stuck with it on your report for 10 years.

You have now provided the CRA with the proof they need to connect you to this BK.

It will very hard if not impossible to dispute it in the future, and you have"glued" (as lbrown59 says) to your report forever!
