We are 2 years post BK....I have a question on the termanology used in the credit report. We filed BK in 11/2000. We had been totally up to date on all bills when we contacted the attorney in Sept. At that point he instructed us to stop making payments to credit cards, which we did.....so from that point to the Nov date when they were contacted and told of the BK...the most days we could have been late were 60 days. We now see on the credit report that these are reflected correctly in that they are a part of the BK...but many say "Maximum Delinquency of 90+ days occured in______"...with that date being after the BK was filed and we were under protection.( 2 even being one year after the BK was filed) Should I even worry about this? I know the BK is bad enough.....but as silly as it seems, I didn't want it to look as though we had stopped paying on these accounts months before we did the BK...or does it really matter? I am getting ready to disput one acct which is showing as part of the BK....yet was never listed as such because it had a zero balance, and then was not used until one year after the BK (they never closed the acct). It has been in good standing for one year now, and I want credit for it! So...I wanted to check on these lates showing before I disputed this one thing. reporting 90 days late/included in bk will hurt the FICO score. bk is not really hurting the score much but the 90 days late is. How do u plan to dispute it?
Thank you for your reply. I'm not really sure how I will dispute it. This is my first day to this board, and there is a wealth of info here. I will have to look further into the best way to dispute it...other than just saying the entrys are wrong...I'm not sure how to word it.
The same thing happens to most of us because technically even though we've "filed" the debt isn't really "erased" as we still aren't "discharged"for at least 4 months. The creditors could care less, it's still time that we did not pay. I can see their point but have also tried numerous times to dispute it anyway. I haven't had any luck with mine who are reporting this way. Cap one, sears and Citi didn't bother, but FUSA and Discover made sure they threw the time of my filing to discharge as lates. No matter how I've disputed it, it always comes back as verified. Just dispute as not mine or never late and see if you get any results. You could also try going through the original creditor and see if they'll remove that way. I have to say, my scores (and hubby's) are pretty good post discharge (all are mid to higher 600's- like you we were current up until we had to file) even with these showing so I don't know how much they really "hurt" score wise. I figure the bk notation is probably more what counts. Good luck! Newstdt
