I have been working on my brothers credit, TU and EQ did not have the address he filed at. He recieved his credit report from TU 2 days ago. BK-deleted, yesterday recieves a letter. BK-verified-reinserted. What is going on? what do I do now? BTW, there are NO accts. showing BK. so no creditors to verify with.
I have never had something like this happen with TU. WIth EQ/CSC it is a daily occurence. I don't know what to tell you. This will give you a bump. GOod luck.

About three weeks ago, this exact thing happened to someone I know. Friend disputed BK as incorrect info. 30 days goes by, nothing from TU. Friend writes to TU, tells them time's up, please delete. A week goes by, the mail arrives. First envelope, yeah! TU deleted BK. Open next envelope, TU re-inserted BK as verified. Thing is, it has the identical incorrect information as the original BK entry. Sounds to me like TU is majorly fudging. They overlooked the dispute until it was too late, and then, when reminded the 30 days was up, came up with a sneaky way to keep it on the report. I posted this when it happened. I thought it was of great importance, because I've read here more than once that public records are never reinserted once they are deleted. Well, guess what. This is beginning to sound like a pattern is developing. Any recourse?
That's why CHOD is the best time to do your BK disputes. If they catch it after it has been deleted, it is harder to get that reinsertion letter out within that 5 day period.
So will it now be harder to get it deleted now that it's been (yeah, right) "verified", and re-inserted?
TU did the same thing to me winter 2000. They deleted my BK-7 then re-inserted a week later. I just kept hammering away until it finally came off that Spring. You need to take a close look at the listing. My BK-7 listing was totally inaccurate. The liability was incorrect they had the BK judge's name wrong, my and my attorney's name wrong. So it in fact was inaccurate and they finally decided to delete about 16 months before it was due to fall off.
Just talked to my brother, he said EQ did the same thing, sent him a letter that says it is being re-inserted, what in the world is going on I have NEVER had a problem with re-insertion before, now 2 of them are doing it? Like I said before, neither has the correct address, so how are they verifying? I have never seen BK papers before, but surely ss#'s are not available for public viewing?
tnobles, Yes, the social security numbers are available for public viewing! Birthdates, address, spouses name, bank accounts, tradeline accounts, mortgage accounts, every last little detail of what you thought was private. It's no longer private when you file BK, that makes the BK filing and all associated documents a public record. Unless you happen to live in one of the few states that forbid it (California). It is, so the address thing does not help me at all here. What should I do now? I mean if I wait until CHOD are they going to mark it as frivilous? I just can not get past that both deleted then re-insreted AND sent the letters. I mean I have read a million times that they rarely send the re-insertion letters, how did I get so lucky?
LOL tnobles, I really don't know how you got so lucky. It may be the only thing TU does right! Is every little thing about it correct? All the dates, assets and liabilities, attorney's name, responsible party, docket #? You know what you could do, you could ask for a copy of the required certification. Besides telling you it was reinserted, did they send you the rest of the required information? name, address? phone number? the blah blah clause that tells you about the consumer statement? To be deleted and immediately reinserted like that seems hokey. Sassy
sassy, I am not real sure, like I said, it is my brothers, he lives in a different city so I am recieving secondhand all of the responces via mail, I am not sure of the information, I did not even ask him anything about it, I just thought for sure it would easily come off b/c none of the accts. are showing BK and they did not have the correct addresses, this was like a slap in the face. I recieved the report that says deleted, but now I am waiting for the letter saying re-inserted. I actually expected for EXP. to come back verified, b/c as you all know, your mother's brother's aunt's uncle's address is in their system. LOL.
Sassy, Can you please refer me to the law that says BK info in California isn't allowed to be made public? Because every last detail of my old BK is on Pacer, and so is my friend's, and we're both in California. And all the newer BK's are on the court's websites. Thanks.

lyttlemac, I'm sorry, it was defeated in your legislature at the last minute! That sucks, AZ never does anything unless CA does it first. Maybe WhyChat will know of any re-proposals since this one failed or can further confirm his sources. I feel it with you, I found myself online and every detail, searchable by my last name.
