Boa After My Mom...help!!

    Hello Everyone,

    Yesterday, my mom told me of harrasing phone calls, and letters she has been recieving from BOA, regarding a $15,000 past due account CC....belonging to my father (they have been divorced since 1987,and we have no clue where he is). I was furious, so I called the CA and they said they would immediatly delete her address and phone number. I asked them to send a letter stating that my mom has nothing to do with this debt, and he said he would. They also said they did not have my mom's SSN#, but I am going to have her check her reports anyway. Apparently this account was closed in 1999,and we think he may have put her info on the application...WHO KNOWS.
    Since you all give such great advice, I was wondering if we should do anything else???

    I'd send a very strongly worded C&D!! CRRR, of course!

    No, you don't want to C&D unless your absolutly sure her name not on the app. She could quite easily be sued!

    Send validation letter and limited C&D (no telephone communication) to the CA.

    And don't talk to them on the phone any more. Tell them all correspondence must be in writing (that's the limited C&D). They can tell you anything on the phone, and you have no proof. Next they'll say they talked to you and you agreed to pay.

    By the way, unless your mother called and then turned the phone over to you, they shouldn't have discussed this with you anyway. Too bad you can't prove it--that would be a violation.
