When I recently checked my CR's I found there were 3 accts listed as charged off. These are all my husband's accts. I never signed an application nor have I ever used any of them. When I disputed, 2 deleted. However, BofA remains. Over 2 years ago I requested verification with BofA. They never responded. They then sold the acct to another lender. They contacted me and I immediately sent a validation letter. Their response was to turn it over to an attorney and ignore my validation request. When the attorney contacted me, I sent copies of my letter to BofA, the collection agency and a new request for validation (all sent CRRR) along with copies of the green cards. The attorneys office signed for this 6-9-03. I have not heard another word. BofA was charged off 4-01. If I compute this right the SOL has run. This is the only derog on my CR. What precipatated this is a rise in my credit card interest rate. My husband has ruined himself, and I don't want to go down with him. I really want this deleted off my reports. Any suggestions? How can they verify what they don't have? Do I not have a right to see my signature on something?
I'd go back to BofA via PlanetFeedback. Write a letter that you're really upset, this is not your account (at this point, don't volunteer that it's your husband's account) and that no one will send you proof that it's yours. List all the contacts, and say that what you want is a copy of the original application with your signature on it. If they have something and it's not really your signature you may have to fill out forgery papers.
I contacted BofA thru PlanetFeedback. Haven't heard anything from them. Pulled my cr's and BofA shows deleted on TU, remains on EX, and I just disputed with EQ. How can it delete on one and remain on the other. What should I do? EQ shows DOLA 9-2000. SOL in Ark is 3 yrs. Is SOL from DOLa or CO? Should I just leave it alone for a few more months. BofA sold it to Portfolio who sent it to attorney in Little Rock. When they contacted me I immediately requested validation. CRRR signed for on 6-9-03. This is not my acct, but I really don't want to have to deal with a court appearance. Since I haven't heard from attorney, would you assume they are unable to validate? Thanks for your help! I really want this off my reports, but don't want to stir things up.
